Dear Sri Gangadharan,

This is the first time I am writing to you but have been a reader of the Chronicle.

While all the other pensioners in the country are benefited by favourable court orders, it is only LIC pensioners who are suffering due to different approach by representative leaders of pensioners groups. It is not that they do not want the benefit but are shy of admitting that the others also have a point. As pointed out by Sri MSM the petitioners should sink the differences in approach and work for the pensioners who they profess they are serving.

The experience in various courts is very rich and has educated us all as to what we should do, more in the light of the fact that the seniors are vanishing as the "pearls of the morning dew - ne'er to be found again".

There is a growing desperation in every pensioner that his leaders may not be training the correct line to realise the benefits while he is still alive. To ward off such thoughts, each leader has to concentrate on GETTING THE SUPREME COURT ORDERS FOR getting the DR arrears upto Aug 1997 and revision of basic pension as from 1-8-97 and subsequent wage revisions.

We should thank all those who have been responsible for getting the judgments in our favour but remind them that TIME IS RUNNING OUT FAST and faster are the exits of the pensioners .

Let us all resolve to focus on what has to be achieved !!!

Govindarajan Krishnswamy, Bangalore

This is his (KML’s) standard response. “Don’t question or comment against my strategy. If you do, I quit, you take over”. Used to be only in small private groups earlier. Good, he is now out in the public. There are two people who are singled out and excluded in all his communications lately. Mr Brij Jit Singh and Mr Sreenivasa Murty. Both raise inconvenient questions on his so-called strategy. Mr K Gopalan expressed a similar view now. All hell broke loose. Here are those questions.
  • 1. The two new cases in Jaipur – (Nos: 3471 -3508 / 2014): Are they not still in 'Notice for Admission' stage? By your own admission, if LIC files a reply, you will have to ask for time to file the Counter. In the meantime Pensioners all over the country will be bombarded with messages on the NEXT DATE of hearing. You know pretty well that the WPs may be admitted or may be dismissed even at this stage. Even if admitted, final decision on the prayers can only be a few years later. If the WPs are eventually allowed, will not LIC go for review/appeal to the Division Bench first and SC later? Why then give all false hopes to pensioners in general in the name of these two new cases? Can you tell in simple language, what you expect from these two cases in Jaipur and when?
  • 2. What have you done to the 13 Feb Order of Justice Chauhan in Jaipur? Have you accepted the dismissal of CC as ‘withdrawn’ to obtain clarification? LIC is sure to quote this again in Chandigarh when their CC comes up on July 7? What is your advice to them to overcome the problem and press for continuing with the contempt matter?
  • 3. What is your real purpose of filing the IA in SC on 6 May in Chandigarh matter? While all the office bearers of the AIRIEF deny any knowledge of this strange move of yours, what is your real aim? Is it done in your private individual capacity? If so are LIC pension cases your private litigation matters?
  • 4. Your winning the cases in Jaipur first and some of LIC’s SLPs being dismissed in SC later – Does it give you permanent immunity from accountability in your later strategy?
  • 5. Notwithstanding the high-decibel outbursts of a handful of your supporters, do you admit that the money you have been spending includes contributions of many pensioners far and wide? Including that of pensioners who are NOT even members of AIRIEF? Has anybody asked you publicly for an ‘Account’?
Why then is all this posturing? What are you defending?
  • 6. IS THIS A PROPER STRATEGY AND IS OUT OF BOUNDS FOR ANYBODY TO QUESTION?
It is never too late. Change the strategy from “I decide everything – if you question, I quit, and you take over”. This is not fair driving.

M.Sreenivasa Murty

LET US BE GRATEFUL TO SHRI ASTHANA, SAYS PANCHAMIA

For GOD's sake nobody should raise any doubts about the sincerity of Shri ASTHANA JI. It is he who has brought us to this level - only a hand away from VICTORY. Shri GOPALAN JI, If you doubt his sincerity/seriousness/strategy - you will be doing the BIGGEST 'PAP'- Sin.

I am sure, if not all, 99% of we friends would not have been able to achieve even 10% of what our GREAT SHRI ASTHANA Ji, has been able to achieve. To be frank, let us all ask ourselves - how many of us knew Shri Asthana ji and what he has been busy all these days? I am sure the answer will be 'NO' from most of us. I for myself never even had heard of Shri Asthana ji leave aside what he had been doing for all of us. Before 5 years only I came to know all these from my INDORE FRIENDS S/s. KHULLAR & V.C. JAIN. My Heartiest thanks to them.

At the same time we all are 'NINCOMPOOPS'. In spite of continuous DELAYING TACTICS adopted by LIC/FINMIN, we are just silent. Not even single friend has volunteered for HUNGER STRIKE before YOGAKSHEMA. Yes I agree we all are aged, (normally) weak in health, mentally as well physically, but that does not mean that we are cowards - when it is question of life & death one has to come up,face off & come out on TOP as a Winner.

ASTHANA'S REPLY TO HIS CRITICS

MR GOPALAN,

I APPRECIATE YOUR VIEWS BUT WHILE DOING SO YOU HAVE FORGOTTEN THAT IT WAS ASTHANA WHO GOT TWO JUDGMENTS IN DIVISION BENCH AT JAIPUR AFTER THE JUDGMENT OF MR JUSTICE BHANDARI AND GOT TWO SLPs DISMISSED IN SC WITHIN A PERIOD OF SOMEWHAT MORE THAN THREE LONG YEARS FROM 12/1/2010 TO 8/8/2013. U MUST ALSO APPRECIATE THAT EVEN THE PENSION MATTER OF THE JUDGES OF THE SC AND HC TOOK 12 YEARS IN THE SC ALONE AND THE MATTERS OF BANKS ARE WAITING THEIR END SINCE 2005. IF YOU HAVE ANY OTHER STRATEGY TO FOLLOW YOU ARE FREE TO PURSUE THE SAME AND I WILL BE THE FIRST PERSON TO LEAVE THIS LINE OF LEGAL ACTION. CAN U LET ME KNOW BUT IT SHOULD BE WORTHWHILE AND NOT JUST A SHOW BUSINESS AS SOME PERSONS ARE DOING. U MAY ALSO TAKE OVER THE MATTER IN YOUR HANDS AND RELIEVE ME OF THIS HEAVY BURDEN.

BUT YOUR SUGGESTIONS SHOULD BE FRUITFUL AND NOT FAKE. MR GOPALAN I ASSURE U I AM NOT MAKING ANY GAIN BUT NOT ONLY MY NIGHT OIL, PATIENCE BUT ALSO OTHER EXPENSES ANCILLARY TO SUCH LITIGATION AND AM ALSO LOSING MY OWN INCOME FROM WORKING IN THE HIGH COURT ON DAY TO DAY BASIS.

FOR YOUR INFORMATION THE 2ND WAS THE FIRST HEARING OF THE IMPLEMENTATION WRIT PETITIONS AND IN SPITE OUR OBJECTIONS THE COURT GAVE SIX WEEKS TIME TO LIC FOR REPLY AND SAID LET US SEE WHAT THEY SAY WHILE THE WRIT PETITION IS NOT ON MERITS BUT ONLY FOR IMPLEMENTATION. THESE SIX WEEKS INCLUDE THE WHOLE OF THE MONTH OF JUNE WHEN THE COURT WILL BE ON SUMMER VACATIONS. EVEN IF TWO WEEKS TIME WAS GIVEN IT WILL NOT BE LISTED BEFORE 1ST WEEK OF JULY.

THEN I ALSO STATE IN ADVANCE THAT IN CASE THE REPLY IS FILED I WILL HAVE TO SEEK TIME FOR COUNTERING THE SAME. AS AND WHEN A REPLY IS RECEIVED I WILL REQUEST YOU TO PLEASE SPARE YOUR VALUABLE TIME TO COME TO JAIPUR AND DRAFT AND FILE THE REJOINDER THEREIN. I WILL RENDER ALL ASSISTANCE.

THANKING YOU

SUGGESTIONS DESERVE ATTENTION

When Abraham Lincoln stood for election Grace Bell a young girl from Westfield wrote to him: “Dear Sir, I am a little girl of eleven year old but want you to be President of United States very much so I hope you would not think me very bold to write to such a great man as you are. You would look a great deal better for your thin face if you let your whiskers grow. All the ladies like whiskers and they would tease their husbands to vote for you and then you would be the President—Grace Bell”.

Lincoln was elected. The special train carrying the President around the country stopped at a station near Westfield. A large crowd assembled to greet the President and when he was asked to speak he opened up “I have a little correspondent from this place. Her name is Grace Bell. The little child wrote to me how to improve my appearance. If she is present here I would like to speak to her. Bell’s parents who were in the crowd with the child brought her before the President. The President bent, lifted her, kissed her on both her cheeks and said “ You wrote I would look better with whiskers. You see I let that grow for you my little friend”
  • Ego and status should not interfere when suggestion comes. Alone, undeterred and unmindful of a hostile weather and the inconvenience of frequent travelling leaving the family aside my good friend Srinivasa Murty has undertaken a crusade for getting the cooperation and assistance from various quarters to discover an end to the legal wrangle and to checkmate any further adjournments. His suggestions deserve attention and not brushed aside.

IF ONLY WE JOINTLY FIGHT THE CASE

Dear Sir,
RBI pensioners got their pension updation by the assertive action of the RBI
Governor Raghuram Rajan from mof. The law ministry agreed to implement pension updation of central govt pensioners effective from 1986 in the curative petition. So LIC pensioners associations if they jointly fight the case in SC can get Raj Hc order of   12-01-2010 implemented. Will they do it?

My hearty thanks to M/s RV Chandrasekharan, MP Agnihotri, BR Mehta, T Sampath Iyengar, CH Mahadevan and several others who are in touch with me, besides a host of silent supporters who follow the Pensioners’ Chronicle. I want to update the Pensioner Community through the Chronicle. I am still in Delhi, talking to Advocates, having returned from a quick trip to Chandigarh on 21st May.

1. I have not given up and will not give up my efforts to convince all the active Petitioners and the leaders of the Federations, as the case may be, to prepare ‘properly’ for the hearing before the Supreme Court Bench in the second week of August.

2. I am NOT asking any of them to give up their rights to realize what they have achieved through the Judgements delivered in their favour, each of which is, as per law, binding on LIC. I am only asking them to press for ‘directions’ from the Hon’ble Supreme Court (they have a legitimate chance and an opportunity to do so in the second week of August) to implement their respective judgements. What I am appealing to them is to REFRAIN from straying in to the other petitioners’ territory, which would only give scope to LIC to step in and work in some way to our detriment. The minimum LIC can do is to ask for and get a long adjournment.

3. In order to do as above, legally exploit the benefit of 4th April 2014 proceedings of the SC, file reply/supplementary Application (on the first day when the Court reopens after the summer vacation) ending with an eloquent prayer in two parts: i) Please dispose of the Civil Appeals urgently (highlighting the most sensitive fact carefully, that the petitioners are leaving the world on a weekly frequency) or ii) “I have the Judgement and Order in my favour, which the Respondent LIC is bound to honour – but not doing so – please direct its implementation pending disposal of the CA against the said Order”. This is the substance of the prayers – the language and the emphasis will be provided by the Advocate/s.

4. Let LIC say what it wants to – let SC intervene as it wants to. SC would easily notice that the Chandigarh Petitioners are demanding 1) DR anomaly rectification for pre-97 retirees 2) up-gradation of basic pension with each pay-revision – 1997/2002/2007, 3) full arrears from 1.8.97 and 4) with interest at 12%. Supreme Court would also notice (with the help of LIC) that the benefits accruing from the Delhi and Jaipur Judgements are lesser in scope and detail. In that situation, the Sr Counsel would have been authorized by the petitioners to ‘offer’ to the Bench, on behalf of all the three Petitioners with prior consultation, to direct granting (AS INTERIM MEASURE) of whatever immediate benefit the Bench feels just and proper. If it comes to, it could be a) arrears on up-gradation without interest, b) full up-gradation but without arrears, c) only DR anomaly rectification for pre-97 retirees, (but necessarily with the benefit of revision due on 1.8.97, to prevent the contemptuous mischief played by LIC while depositing money in Jaipur HC registry and ironically sought to be ignored by Delhi Petitioners in their IA heard on April 4th). If Supreme Court grants DR anomaly rectification for the pre-97 retirees only, without rejecting the other reliefs for the time being, we should be willing to take it as a consideration to the ‘worst affected’ among us. The Sr Counsel team should be able to take control of the situation in the open court, after winning the sympathy of a benevolent Bench. What is important is that the matter as a whole is NOT allowed to drift to an indefinite future. That is where well informed Sr Counsel, slapped with no conflicting instructions from our Petitioners (for example and in a lighter vein “Mr. Sr Counsel, I don’t care what happens to my case – but make sure the other fellow gets nothing from the Hon’ble Court. Tear your counterpart’s arguments to smithereens”).

5. I renew my appeal to the Petitioners of Delhi & Jaipur: Make supplementary submissions in response to SC proceedings of April 4 to be able to pray for directions to implement the Judgements dated 30.01.2013 & 12.01.2010 respectively.

6. Prepare and keep ready the comprehensive written arguments in CA Nos 9223/2013 and 8959-62/2013 (without being ready on that, you have no case to ask for urgent disposal of the Appeals listed before the Bench)

7. The total strategy should be that the petitioners in Jaipur, Delhi and Chandigarh HCs should not appear to be fighting among themselves, to the advantage of LIC and to the inconvenience of the Supreme Court.

8. I have come across some dealing advocates, not fully familiar with all the facts of our cases. It is our duty to ensure that the advocates on record as well as the Senior Counsel are fully briefed to the point of 100% control on facts of the case. The fee paid is also for the time spent with the client to discuss the case thoroughly.

9. I don’t claim I know all the relevant law. But I do know how cases are won by winning the sympathy of the Bench, especially in cases like ours. The first task is to convince our counsel how strong is our case. If we succeed there, half the case is won. I am open to correction if the petitioners in Jaipur & Delhi and/or their leaders have any better strategy than what is discussed above.

10. If Delhi and Jaipur do not agree with this line of approach, (or don’t share a possible better plan they wish to pursue), they owe an explanation to their co-pensioners, throughout the country hoping and waiting for justice.

11. To the query from Mr Sampath Iyengar: Yes, I do have a Plan ‘B’, which is a gamble (I file an Application for Intervention before the SC myself) and also a Plan ‘C’ which will prove a WMD. Aimed at the wrong doers of all their wrong doings against the trusting LIC pensioners.

CH MAHADEVAN

Sir,

I have seen all the statements of Srinivasa Murthy. I personally heard him in Bangalore recently. Here is a man who is trying to unite all the leaders with a missionary zeal. As far back as 4-4-2014,when he was in SC, he met all the leaders who matter and started the process of uniting them for a common legal fight. At the time we thought he had succeeded but his recent comments indicate that the desired objective may not have been fully achieved. Hopefully he is in touch with them. He is on record has not given up and working whole time to clear the cobweb for a united legal battle in SC. We all pray that he succeeds in his efforts.

I agree with Mehta that the development in this regard may be shared with us all through your valued channel.

I wish Srinivasa Murthy think of a Plan B, in case his efforts fail depending on how much co-operation
he gets and from which quarters. If he can let us know such plan B, in case he so wishes, it would be fine.

Dear Mr Gangadharan,

I am attaching a chart prepared by me showing the increase in premium payable in 2015-16 compared to the premium payable for 2014-15 (current year), as retirees may like to know the likely increase next year while deciding on their option.
  • It has been prepared for all the three categories under Table A (Retirees, Spouse of Deceased Employee & Spouse of Deceased Retiree) and Table B (Dependent and Additional Dependent of Employees/Retired Employees) where premium subsidy is applicable.
  • Kindly upload the same in your blog for the benefit of pensioners. I heartily acknowledge the assistance rendered by Mr R.K.Sahni in checking and finalizing this chart.

Kind regards.
C H Mahadevan.

REALLY WORRIED

On 22  inst we thought that something worthwhile would emerge when the Bench sits and to our dismay and worry the hearing was postponed to July. Then will come the Puja and Christmas holidays not to speak of the endless adjournments sought by LIC. All these are causing enormous worry to the helpless ageing and ailing pensioners and I am no exception but the unfortunate thing for me is that I am 81+ with old age blues.

The other day I was browsing the web site: www.reallyworried.com and could get useful information on worry. An average urbanite spends two hours of the day fretting, a futile exercise of the confused mind. The American humorist Boombeck has said it beautifully :  “Worry is like a rocking chair, it keeps you going but gets you nowhere “ About 75% of our Pensioners worry is about the prolonged court cases, my junior who retired later is getting more pension than me. And mind you this worry is when you are in solitude and half of those who worried at home did so in their bed room and if you ask them they say the worry comes to them between 10 and 3 AM,
To the Chronicle editor, worry
came rushing 19 minutes past 3 AM on 16-5-2014
when he suddenly got up to update the blog!
the time you are supposed to relax in the soft embrace of sleep between the arms of your better half and thus both suffer.

A worrying mind is a shallow mind. It is always in turmoil. So why worry about our court cases. What should happen let it happen when it should happen. So forget the worry, be cheerful and get going.

JOINT LEGAL BATTLE IN SC

This is in response to a post today on LIC Pensioners Chronicle by our learned friend Sh.M.P. Agnihotri.

All right thinking LIC retirees who read LIC Pensioners Chronicle regularly fully agree
Different issues "BOTH, JUST & ONLY"
How on earth you think we can go together !
about urgent need for Joint Legal Battle in Supreme Court for coming God sent opportunity on 12th August,2014.

Time at our disposal is very short keeping in view lot of preparations to be made in this context.

But it appears that nobody is listening. My simple question to all leaders in both Sridharan/ S.K.Kapahi Camp as well as AIRIEF camp lead by V.C.Jain/ S.K. Shukla is:  Why things are static and not moving in right direction thereby giving a loud message to all concerned that Top Leadership of both camps has agreed in principle to move unitedly with a very clear blue print in this direction.

Will our readers help enlighten me as well as others about any such development at top leadership level pertaining to both camps?

In case leaders agree that things are not moving in right direction then let them enlighten all of us what to do next for desired result?

Dear Sir,
The legal battle on DR anomaly & pension updation by LIC pensioners is anxiously being observed by the pensioners of all PSUs in insurance & banking industries. Success in Jaipur HC at all three stages shows the hard work and legal expertise of Shri Asthana and those behind him. Cases filed in Delhi HC & Chandigarh HC have also been prepared and pleaded with equal diligence and legal expertise and are won. Judgment of justice Bhandari has helped as a favourable ‘Ratio decidendi’ in the later cases. These judgments do serve the very purpose of LIC pensioners. Unfortunately, LIC under directions of Finance Ministry Bureaucracy is embroiling the pensioners in endless legal battle. The leaders of various pensioners’ groups / petitioners are making efforts to come out of the web cab and get a final favourable order so that the aggrieved pensioners get relief at the earliest. Such efforts sometime may go futile, which I do feel may be by chance and not for any other reason.
  • Analysis of Shri M Srinivasa Murty is praiseworthy. It will help the petitioners / leaders of various unions to safeguard pensioners’ interest from the malevolent acts of UOI/ LIC. I hope his ideas will receive attention of all concerned and necessary steps will be taken so that UOI/LIC would not get any chance to take undue advantage of any sort of differences in approach by various groups of pensioners.

JAIPUR CASE NOS. 3508, 3471/2014

THESE WRITS WERE LISTED TODAY (22-05-2014). WHEN THEY WERE CALLED LIC COUNSEL SOUGHT TIME FOR FILING REPLY.

  • WE OPPOSED THE SAME THAT NO MERITS CAN BE DISCUSSED THEREFORE THIS IS NO QUESTION OF REPLY AND DIRECTION BE ISSUED FOR MAKING PAYMENT IN COMPLIANCE OF THE JUDGMENTS BUT THE COURT SAID THAT THIS IS THE FIRST DATE THEREFORE IT WILL BE FAIR TO GIVE THEM ONE OPPORTUNITY AT LEAST, THEN THE LIC COUNSEL WAS ASKED AS TO WITHIN WHICH TIME THIS REPLY WILL BE FILED.
  • ON HIS ASKING THE COURT GAVE TIME FOR SIX WEEKS, (OUT OF WHICH WHOLE OF JUNE IS IN SUMMER VACATIONS) THEREFORE THE CASES ARE LIKELY TO COME UP IN THE FIRST WEEK OF JULY.

NEED OF THE HOUR

with the support of
entire pensioners community...

DEAR SHRI GANGADHARAN,
editor at work.

Let me first compliment u for the good work that is being done by u. We are able to get news first hand, very promptly can u  take up our cause a step further to the logical end by mobilising pensioners as one group across the country. That is the need of the hour. I am sure u can do it through ur medium of communication which is so strong.
  • Shri Murthy's article is interesting, thought provoking. It is time to act by we-the-pensioners together.
  • LIC pensioner which ever group he belongs to should vote for formation of a common front as suggested by shri Murty, hardly we have any time left months of June--July will pass off with the wink of an eyelid
  • Leaders of the groups have to shun their ego-centric views and meet at a common place quickly, evolve strategies, which will help in finding a solution to our long pending problem.through your blog. Please inform pensioners to vote for common front. Let every pensioner give his might for this cause.
R.V.CHANDRASEKHARAN

SREENIVASA MURTY MULUKUTLA

an insight into ongoing court cases...

In my last post in the Chronicle I consciously alleged that we the pensioners ourselves and some of our leaders are to blame for the current state of affairs which is frustrating. I wish to explain myself and share some information for proper appreciation by the general pensioner community.

The Judgements in favour of the Petitioners delivered by the three different High Courts are INDEPENDENT of each other and stand on their own feet in law, notwithstanding the fact that Jaipur Judgement is cited in support by the other two HCs. It is so because the petitioners are different, prayers are different and the relief granted was also different in its detail. Consequently, the petitioners before EACH HC are entitled to pursue their judgements for their due implementation in accordance with law.

It cannot be disputed that all the three Judgements became final and binding and LIC has no justification for 'sitting' on the same indefinitely.

But what is happening in our case? Delhi Petitioners want to meddle with the Jaipur Order, by praying for payment/depositing of the amounts as was done in Jaipur. Luckily no damage took place in Supreme Court on April 4. Don't they know that what was deposited by LIC in Jaipur HC Registry was NOT even in according with the LIC Board Resolution and that LIC played a joke by not even rectifying the DR anomaly for pre-97 Retirees while depositing the amounts? Although Justice Chauhan of Jaipur Bench specifically directed LIC to explain the basis of the amounts deposited in its Registry, LIC was able to get away with a casual non-compliance of the specific direction of the Court and the Petitioner failed to establish even such a glaring contempt, during the hearing on 12th and 13th February.

More shocking now is the fact that Jaipur Petitioners want to be impleaded in Chandigarh case despite strong opposition from Chandigarh Petitioners. This, in addition to the two new futile WPs already filed in Jaipur. An IA was filed in Supreme Court on 6th May. Why, what for? The reason given in the IA was that Chandigarh judgement is based on Jaipur Order. So what? Is the Jaipur Judgement their 'private property'? Ostensibly to 'protect the interests of pensioners'. In what way? What is it that they can present before the SC in a big way which the Chandigarh Petitioners themselves cannot? Or is to give a handle to LIC to prolong the cases indefinitely. Keep knocking at Supreme Court doors on some pretext or other but not ask for implementation of your respective judgements. Strange and incomprehensible.

In order to do that, the Petitioners have to immediately fulfill certain formalities. Make a demand to LIC through a legal Notice for payment of CRYSTALIZED amounts individually due under the Judgements. It is possible to do so in respect of Jaipur and Chandigarh cases because they are independent Petitioners/Pensioners. In respect of Delhi Petitioners, a representative sample of calculations of ALL types of Pensioners - pre-97, post-97 and family pensioners should be presented to make the CRYSTALIZED demand. Non compliance by LIC (as can be suspected) would give the Petitioners the RIGHT/OPPORTUNITY to press for 'directions' to LIC. It will not be easy for LIC to escape liability. Question of several other proceedings pending before various courts, will certainly figure before the Bench. The two new WPs in Jaipur, the latest IA before SC for impleadment and the Contempt case before Chandigarh HC are all potential impediments (possibly even the Contempt Petition dismissed as withdrawn by Jaipur Bench) for any 'directions' as LIC can be expected to play the usual games to delay implementation. In that event Sr Counsel representing each of the three groups of petitioners can be authorized to offer to the Bench to withdraw all pending cases in return for suitable and firm directions to LIC to honor/implement the judgements that became final.

We can hope for a sensible and fair outcome if and
only if the petitioners stop pulling and pushing their and others' cases in different directions at the expense of

the hapless pensioners but instead make a concerted plea before the SC Bench with a one line prayer 'direct LIC to implement their respective Judgments'.

Chandigarh Petitioners are proceeding on the above lines. Will the other two follow suit? If they don't, what should their members/pensioners do? Not even question?

JAIPUR CASE ADJOURNED. CASE TO BE TAKEN UP AFTER COURT VACATION, IN JULY 2014

Re: the query in the PC

the recent circular only provides Special Entry for serving employees but not retirees as per the attachment.

Kind regards.C H Mahadevan

Dear Mr.Gangadharan

I am a  LIC emloyee retired in the cadre of SDM. I am also one of the fans of your CHRONICLE.
Thank you for reminding about the last date for opting the desied Mediclaim cover. You have also given a chart indicating the premium payable for different Floater cover for different ages. It is quite useful to arrive at the premium payable for the year 2014-15.

I have a formula whereby one can calculate the premium payable for the year 2014-15 (which includes the Premium for Additional Floater cover for 9 months payble by employee/retired emploee).

The formula is: 0.75 x - 0.50 y,where x represents the premium for different ages for the desired floater cover (for example 8 lacs, 10 lacs or 20 lacs)
and y represents the premium for different ages for compulsory Floater cover (may be 3 Lacs, 4 Lacs or 6 Lacs accaording to the category to which one belongs to).

Here the premium for husband's age and wife's or dependant's age may be added and taken as x or y as the case may be.

If one is not opting for additional Floater cover (ie remaining at compulsory Floater cover) the Formula is simple: It is 0.25 y.

An example is worked out below:
Husband's age 76: Compulsory floater cover Rs. 6 lacs: Premium for this cover : Rs.17,442
Wife's age 67 Compulsory floater cover Rs. 6 lacs Premium for the cover : Rs. 3,998
Total Premium Rs.21,440 which is taken as y

Husband's age 76 Total cover (including compulsory cover of Rs.6 Lacs) Rs.8Lacs; Premium for this cover: Rs.19,535
Wife's age 67 Total cover (including compulsory cover of Rs.6 Lacs) Rs.8Lacs Premium for this cover Rs. 4,478
Total Premium Rs.24013 which is taken as x

Applying the Formula: 0.75 multiplied by x minus 0.5 multiplied by y
= 0.75 multiplied by 24013 minus 0.5 multiplied by 21440
= 18009.75 minus 10720 = 7289.75 (rounded off as 7290

If the above persons opt for only compulsory Floater cover of Rs. 6 lacs the premium payable is : 0.25 multiplied by 21440
= 5360.00

Note: The Premiums are taken as per communication received from Divisional Office, Coimbatore'
If you feel that this is useful for us (LIC employees/retired employees) you may kindly publish in LIC Pensioners' Chronicle.

...I expect nothing from LIC
and nothing from the Government.
Much less from the 'in service employee
organisations'...Shri M.Sreenivasa Murty.

Shri MSM is cent percent -100%- right. The sad and deplorably bad experience of the pensioners, seventy and plus year old in particular for the last one and half decade is a telling reality, a commentary. All of them have been subjected to inconceivable ill treatment by both GOI and LIC.

The surviving Pre-August,1997 employees numbering few thousands - retired during 11 years and 7 months period 01-01-1986 to 31-07-1997 are the worst sufferers. Their number is reducing at accelerated rate. Their count is dwindling - both in the sense of number and importance - the latter is used for fun, not (necessarily) so, the Elders by and large still command respect! The Leaders may provide the figure of pensioners/ family pensioners as on 01-08-1997 and the number of pre-August,1997 pensioners/ family pensioners as on 31-03-2014 or the latest available data.) These few thousands are the most neglected beleaguered lot of LIC with undying hopes of ostensibly bleak prospects of getting 100% DA/DR and updation despite the fact all those retired during last 16 years and 9 months period from 01-08-1997 to 30-04-2014 and retiring on a subsequent date do get 100% DA/DR. What a cruel joke of justice between pre and post August,1997 pensioners!?

LIC Pensioners Chronicle also carries in its Blog the developments elsewhere in regard to pensioners of GOI. Banks including RBI. In a recent article posted in LICPC, it has been stated that the RBI pensioners and family pensioners are going to get updation of pension. The GOI has accorded RBI in principle approval for updation of pension subject to fulfilling/on certain conditions.

The United Forum of RBI - of four Associations / Unions reportedly striving hard - they had gone on two days strike, hold demonstrations (silent morchas) at the Bank's offices where the Bank's Board Meetings are held - all for the cause of their senior pensioners, for updation of pension. The leaders of the United Forum and also the leaders of Reserve Bank Retired Employees' Association meet the Top Management, the CGMs, EDs, DGs concerned and the Governor. All the past Governors were and the present Governor Dr.Raghuram Rajan is sympathetic and appreciative of the pensioners' demands and all of them have taken all possible sincere steps including interaction with the officials of GOI and the FM.

The pensioners of RBI have achieved 100% neutralisation in DR, the Family Pension -30% of 'enhanced' basic pay of the deceased spouse, among others. The pensioners are very much hopeful of getting pension updation may be from 01-11-2012, in couple of months. All the pre-1997 pensioners of RBI have got updation of pension as per 01-11-1997 scales of pay during the tenure of Governor Dr. Bimal Jalan.

It was contested by the MOF, GOI. The pre-1997 pensioners continue to get updated pension as of Nov. 1997 pay as the Bombay High Court has stayed the order of GOI. It is up to RBI pensioners to go/not go to court to get pension updation retrospectively from 01-11-2002 pay revision, updation along with revision of scales of pay once in five years.

I wish, we all pensioners wish that the SERVING EMPLOYEES and their UNIONS extend their help, their might for the cause of their seniors, struggling to get their rightful dues for last sixteen long years. The updation of pension and 100% DA/DR are reasonable demands of the senior pensioners. We, pensioners, do believe that the working employees do appreciate that the demands are genuine, just and not at all unreasonable compared to the position in GOI and RBI.

The working employees may do their best that they can do for the good of their seniors. The updation of pension, once introduced in the LIC, is going to be a boon, a blessing to future pensioners as well.

The leaders of all Associations/Unions may meet the Chairman and other Executives more frequently and unitedly - on common issues. The Chairman and other Executives may play proactive role, use their good office with GOI/MOF officials and the FM etc. to get resolved two long pending issues of 100% DA/DR and updation of pension at the very earliest. The entire class of pensioners are grateful to serving employees, leaders of serving and the retired employees unions/associations to the Chairman and other Executives in anticipation of very fast action and fruitful outcome.
