Dear Mr Sahni,

There is a lot of confusion among  pensioners  about 100% DR neutralisation. According to me 100% DR neutralisation only  happens when the DR per slab of Basic Pay/Basic Pension  is worked out at the same percentage irrespective of the amount.Such a pattern has emerged only after 1/8/1997 when the DR per slab is calculated as a uniform percentage of Basic Pay/ Basic Pension for all employees/pensioners.

There was no 100% DR neutralisation  for employees/pensioners before 1/8/1997 because the DR formula was designed  to calculate % of DR slab  on some tapering slabs.One formula was applied to pre-August 1992 pensioners and another formula  was applied to pre-August 1997 pensioners.Also the DR  formula was  anomalously included in the LIC of India Pension Rules,1995 which  showed reduced slabs( on the 50% of average emoluments as pension)  to   50% of  the slabs  which  were applied to in-service employees.This  resulted in lack of equitable  neutralisation of DR  between pensioners  and in service employees.

For retirees from 1/8/1987 to 31/7/1992, the % DR neutralisation ranges from 100% at the lowest slab(1250)  to 65.1% at   the highest  Basic Pension of ED of 3500.  For in- service employees DR neutralisation  ranged from 100% to 94.9%.

For retirees from 1/8/1932 to 31/7/1997, the % DR neutralisation ranges from 100% at the lowest slab(2400)  to 63.8% at   the highest  Basic Pension of ED of 7000.  For in- service employees DR neutralisation  ranged from 100% to 94.6%.

This was the source of pre-August 1997 DR anomaly in pension.This was  made out as lack of 100% DR neutralisation, whereas there was only a maximum DR neutralisation of    95%  for in -service employees.

LIC  in its  Board Resolution dated 24/11/2001 decided to remedy the situation  and  rationalise the DR  from 1/11/1993 and merge DR with Basic Pension on  1/8/1992 &1/8/1997 and upgrade pension with  weightage of 11.25% as is done for in-service employees.

The Jaipur  single judge Bench order dt 12/1/2010 while allowing the WP  No 654/2007, in effect,had ordered upgradation of pension on substituted scales of pay on 1/8/1997 and also  that  pensions should be  revised  at the time of wage revisions.

But LIC  has conveniently misinterpreted the Board Resolution  to only provide for merger of DR with basic pension  on 1/8/1997  without weightage  on par with in-service employees and  without extending the same principles for upgrading pension on 1/8/2002 & 1/8/2007 just making their exercise an one time affair.
I agree with you that  mere removal of DR anomaly and providing 100% DR neutralisation  on 1/8/1997 will give very little benefit  unless weightage is given for upgradation and it is done in chain at the time of every wage revision.

Kind regards.
C H Mahadevan

Shri Sahni's letter

Dear Shri Mahadevan ji,
I would like to know what is 100% DR neutralization and how
much it is going to help our pre 8/97 retirees financially.

Please let me know the 100% DR rate per slab.

It is being said that post 8/97 retirees are getting 100% DR neutrilization.
In my opinion this assumption is not true. Every retiree is getting 50% of basic pay as Basic Pension and rate of DR is exactly 50% of rate of DA on Basic Pay before retirement whether the DA formula was on slab basis as it was before 8/1997 or percentage basis as is in post 8/1997. Without pension upgradation with each wage revision, it is of a little financial benefit.

Good Cartoon. Mention before SC was first made by Asthana, says Aggarwal (not Murty). Murty was only watching the navigation and made several remote-control mid-course corrections to ensure 'proper landing'. Finally it landed smoothly to the relief of all.

Asthana's statement

SINCE THEN THE CASES ARE BEING LISTED IN WEEKLY CAUSE LIST FROM THE BEGINNING OF AUGUST BUT HAS NOT REACHED AND HAS TRAVELLED BY ONE STAGE ONLY IN THIS WEEK.ON THE OTHER HAND IT WAS THE ARGUMENT OF THE REGISTRY THAT AS PER THE ROASTER IT WILL BE TAKEN UP BEFORE JUSTICE DEEPAK MISHRA.

Asthana 'mentions' for his own appeal

Dear Sri Gangadharan,

I am in (in the hallowed precincts of) Supreme Court.
I can see justice being delivered allover to all those who deserve.

Mention has already been made today by the Counsel for
Mr Asthana. But, for his own Appeal without notice to others.
GOOD FOR ME, as my purpose is fully served.

We will ensure that all Appeals are listed on the same day.
We will know the date by evening.

Dear Mr Gangadharan,

IN HIS POSTING IN PC, MR ASTHANA HAS STATED “MR GNS AND MSM BELONG TO
CLASS I OFFICERS FEDERATION AND THEIR EFFORTS ARE CONFINED TO DA/DR BUT
MY EFFORTS ARE MORE ON UPGRADATION OF PENSIONS AND ALSO ON DA/DR”.

  • I CANNOT TALK FOR MR GNS,BUT I CAN CONFIDENTLY SAY THAT MR SREENIVASA MURTY’S EFFORTS ARE A LOT MORE FOR UPGRADATION OF PENSION FOR WHICH THERE IS ABUNDANT DOCUMENTARY EVIDENCE.IN FACT HE HAS BEEN CRUSADING FOR GIVING UP THE NARROW OBJECTIVE OF ACCEPTING THE LIMITED BENEFITS THAT LIC IS TRYING TO PASS ON TO PRE- AUGUST 1997 PENSIONERS THROUGH A DISTORTED INTERPRETATION BY LIC OF THE BOARD RESOLUTION DT 24/11/2001.

With greetings,

Editor's clarification

IT IS NOT UNDERSTOOD HOW WITHOUT THE ORDER OF THE COURT NOTICES CAN BE SERVED ON LRS. NOBODY HAS GIVEN THE NAMES AND ADDRESSES OF THE LRS SO FAR. FIVE OF OUR RESPONDENTS HAD DIED OUT OF WHOM I HAD ADDRESS OF ONE AND HE HAS ALREADY BEEN IMPLEADED AND I DO NOT HAVE THE ADDRESSES OF THEIR LRS.  UNLESS THE COURT CONDONES THEIR PRESENCE THE SLP HAS ALREADY ABETTED.

MR MURTY IS NOW MENTOR OF CHANDIGARH. DOES HE KNOW HOW MANY OF THEM HAVE EXPIRED AND WHETHER THEIR NAMES HAVE BEEN CONVEYED TO THE COURT?

IN ANY CASE THE SLPS CANNOT BE TAKEN UP FOR ACTION UNLESS ALL THE LRS HAVE BEEN SERVED AND ABETMENT HAS BEEN REMOVED. I HAVE BEEN TAKING ALL THE EFFORTS TO GET THE MATTER EXPEDITED AND PAVING A WAY OF QUIET AND EASY VICTORY WHILE THE APPLICATION MOVED IN THE RECENT PAST WITHOUT INFORMIG ME AND PROVIDING ME A COPY IS LIKELY TO GIVE A JOLT IN THE EFFORT. MR GNS AND MSM BELONG TO CLASS I OFFICERS FEDERATION AND THEIR EFFORTS ARE CONFINED TO DA/DR BUT MY EFFORTS ARE MORE ON UPGRADATION OF PENSIONS AND ALSO ON DA/DR.

  • I HAVE NO OBJECTION IN A MEETING BUT THE MEETING SHOULD BE FAIR AND OPEN MIND. IT CAN BE HELD AT A PLACE FIXED BY MR VC JAIN OUR GS AIRIEF. BUT NOT DURING THE NAVRATRI DAYS. IN THE MEANWHILE THE SLPS ARE NOT COMING UP.
  • BUT THE FIRST CONDITION THAT THE PERSONS COMING UP FOR MEETING SHOULD HAVE FAIR MIND AND OPEN CARDS AT LEAST IN BETWEEN AND NOT LIKE THE PREVIOUS DAYS WHEN THEY HAVE BEEN PLAYING A GAME OF HIDE AND SEEK.
IN THE RECENT PAST I HAVE MESSAGES THAT FALSE NEWS HAVE BEEN PUBLISHED IN THE CALICUT BLOG AND EVEN ON SMS ABOUT MY HAVING GIVEN CONSENT WHILE THERE WAS NO TALK AT ALL. THIS I FEEL IS A WRONG PROCESS AND SHOULD BE STOPPED.

KML ASTHANA
*Mail addressed to Chronicle with copies to VC Jain, SK Shukla and HK Aggarwal.

(We have to explain that we don't publish any news knowing the same as 'false'. We don't know the news Shri Asthana is referring to. He also says SMS is going round with such false messages. Here Shri Asthana and for that matter AIRIEF should have come forward to correct any such messages. Chronicle, which is working almost 24 hours, can project such 'corrections' if given with the prominence such messages deserve. -Ed.)

'Mention' matters

Dear Editor,

This refers to ' Mention to take place soon ' by Shri Sreenivasa Murty.  Most of the pensioners individually or collectively fighting for their long pending legitimate rights are over 70 some of them past 80 in age and most of them are suffering from age related diseases and living with borrowed time. To them an early settlement of what they should get by several court decrees awaiting the final order from the Apex court is what they are very much concerned.

In the interregnum unfortunately several of their counter parts left this world and this is what is worrying them  for they could also be a victim. The way how the wheels of the judiciary is grinding slowly the news that there is from the Constitution a privilege to us called "Mention" whereby we can convince the court for an early hearing brought cheers to these hapless pensioners. Ours is a fitting case to ask for Mention as we have several genuine reasons to ask for it and on humanitarian grounds too. Be that as it may I do not know in what way such a genuine request on humanitarian grounds would fail to invoke sympathy from the Hon Judge who gives a hearing and in what way it will interfere the other contemplated actions in the suits.

Having reached the last stage and very near to the goal let there not be any bickering among us and any good move from any direction should be endorsed with the fond hope that there are no more tiring adjournments and no more from the pensioners fraternity leaving this earth before the final outcome from the apex court. This shall be my prayer.

R.K.Viswanathan

(Other mails on the subject are not being published for the present and are kept aside. -Ed.)

Aggarwal calls for truce

'Mention' to take place soon

In the absence of any fresh response from any other quarter, either directly or through the Pensioners' Chronicle, I am going ahead with the proposed plan for getting the matter 'mentioned' before Justice Dipak Misra. Needless to state, all prescribed procedures shall be followed.

I will be in Delhi from this evening till 26th. Will do my bit to serve the LIC Pensioner community as a whole. Proposal to 'mention' is a very very small beginning, and not 'be all and end all' for us. Irrespective of the outcome of the 'mention' move, the real challenges are still ahead. It is never too late to come together, sink differences and work to improve the lot of ALL Pensioners.

Thanks and regards,

Shri Mahadevan's letter to the Chairman

The letter dt. 21-09-2014 to the Chairman of LIC, pointing out the discrepancies
in the calculations in respect of the arrears for which the petitioners in the categories
of pensioners/family pensioners are entitled in the P&H case is, to say the least,
brilliant, in highlighting the blatantly wrong interpretation of the Board Resolution
and Mr. Justice M.N. Bhandar's judgment and Order of 12-01-2010.

It is a mystery that highly intelligent personnel at the top echelons of LIC can take

such a highly skewed view of things detrimental to the interests of their erstwhile
colleagues, who occupied these positions with distinction while they were in service,
and to whose shoes the present ones are going to get into some time later, to face the
same predicament !

I congratulate Shri Mahadevan on ably espousing the cause of this lot, who are

not even awareof these injustices, who are so feeble that their voices cannot be
heard by the LIC's Top Management even had they cried and who would be ever
grateful to you for your thoughtful service !

May your tribe increase and flourish !

With best regards,

A. Balasubramanya

We wish to inform the readers that we have sent a mail to Shri KML Asthana and Shri HK Aggarwal in view of the following message and an urgent reply is expected from them.

Shri Asthana's positive response.
2.  This reply from Shri Asthana will not be published.  The same will be passed on to Shri Srinivasa Murty for his information.

3.  Shri Murty may require the facility of a conference call for talking to Shri Asthana and his Advocate for clarity and a clear understanding in all matters.  For this purpose Shri Asthana may suggest a suitable time when Shri Asthana's Advocate would be available for conference call.

4.  We have been receiving responses from readers on this subject.  The same will not be published as we are afraid that a debate at this point of time may mar the prospects of an understanding among parties for conducting the case with active and positive cooperation among themselves.

Letter to Chairman

21/9/2014
The Chairman,
LIC of India,
Cental Office
“Yogakshema”,
Mumbai

Dear Sir,
Re: Anomalies in Family Pension under LIC Pension Rules, 1995.

Although  representations have been made by LIC Pensioners’ Associations  for  quite a past few years  for revising the Family Pension  which is  found highly inadequate, the glaring anomaly in family pension  has  come in significant focus in the context of the  calculations made by LIC  for making a payment of dues  to the petitioners  to the Registrar Punjab & Haryana High Court, Chandigarh  under C.O.C.P. No.2975 of 2013 arising out of C.W.P. No 16346 of 2010,

On going through the basis adopted by LIC for  calculating the  difference  in pension payable  to the petitioners ,it was noticed that  in respect of the  4 family pensioners, not only there were  no arrears payable, but  there  were also recoveries  from the  family pensioners. Interestingly, the recoveries were adjusted from the arrears payable to the deceased petitioners and  the total arrears  were shown as a consolidated single amount instead of giving a break-up for regular pension and family pension.

Consequently I attempted   calculation of family pension for all cadres from Assistant to Executive Director by assuming   two dates of retirement as 31/7/1992 and 31/7/1997 and the date of death as 30/6/2013. The Basic pay was assumed as at the maximum of the scale as applicable on the date of retirement.

The   calculations are shown in the attached TABLE A & TABLE B. It is clear from the illustration that if the method adopted by LIC is followed for upgradation for pension  as was done while depositing the amount in Chandigarh HC Registry and also earlier in Jaipur HC Registry, not only the regular pensioners, but also-more intensely-family pensioners will suffer injustice. The calculations may kindly be got verified for accuracy by the Central Office Personnel department.
Reportedly there were 12335 family pensioners in LIC as at 31/3/2013.Not only these pensioners, but also the family pensioners of the subsequent period will be the sufferers if the anomalies are not removed. It will be appreciated that nowhere in the world, upgradation of pension results in recovery of pension.
The family pensioners are a helpless lot with no one to effectively take up their cause for obtaining justice. The very noble purpose of notification of   LIC Pension Rules 1995 will get defeated if family pensioners are left high and dry.

The main reasons for such anomaly in family pension are as follows:

1.       Basic faulty formula  adopted for fixation of family pension;
2.       Wrong interpretation  of LIC Board Resolution while calculating revised pension for pre-August 1997 retirees without;
Ø  Removing the anomaly of differential DR slabs  for pre Aug 1997 retirees and  in-service employees  upto 31/7/1997;
Ø  Providing weightage  after merger of DR with Basic Pension  up to 1/8/1997 as was done for in-service employees;

3.       Not  adopting  the  similar upgradation process  on 1/8/2002 and 1/8/2007 also for pensioners and family pensioners(with suitable weightage after DR merger) which is  also envisaged in the Jaipur Single Judge Bench Order dt 12/1/2010 especially while allowing the WP no 654/2007 which has been refused to be stayed by the Supreme Court.

As the Corporation is aware, the   persisting delay in equitable upgratdation of pension and family pension is taking its toll on the hapless pensioners with obituaries being reported by the week.
I am sure as an enlightened financial institution with a great image as success story as a nationalized Life Insurance Corporation of over 58 years, the Corporation will not allow such anomalies to linger frustrating a helpless   group of pensioners and family pensioners who are in the evening of their lives.

I hope you will use your good offices to get the situation remedied at the earliest.
Thanking you,
Yours faithfully,
C H Mahadevan

ASTHANA'S POSITIVE RESPONSE

AGGARWAL'S POSITIVE RESPONSE

HK Aggarwal's comments

DEAR EDITOR,

LICPC published these remarks today.
"Can Sh KML Asthana have a different stand than UNITY".

THE ABOVE REMARKS smack of some negative thought, something fishy and  seems biased,
as there has always been unity amongst the pensioners irrespective of their class or cadre or affiliation to any union or federation in supporting Sh KML Asthana & AIRIEF in their successful legal fight for the last over 15 years. Present talks of Unity by some  well wishers of pensioners are welcome if there intentions are really for the good of all, but from the sequence of events for the last over a year or two, being differently followed,  show something fishy that is harmful and can create hurdles & more delay in the delivery of Justice.

EVERY BODY HAS THE RIGHT AND LIBERTY TO EXPRESS OPINIONS, VIEWS ON MATTERS CONCERNING LIC PENSIONERS AND UTILISE HIS TALENT FOR THE GOOD OF ALL, BUT SHOULD NOT ACT IN A BIASED MANNER OR WITH EGO TO UNDERMINE OTHER'S SOLID CONTRIBUTIONS. NO BODY CAN DENY THE SINCERITY OF PURPOSE, PROFESSIONAL ACUMEN, DEDICATION AND DETERMINATION WITH WHICH SH. KML ASTHANA HAS BEEN CARRYING ON THE SUCCESSFUL LEGAL FIGHT FOR THE LAST 15 YRS AT THE COST OF HEALTH & FAMILY

Please go through the detailed mail from Sh KML Asthana on the issue below and please publish it in LICPC  if possible along with these comments made without any prejudice towards any body but only for the welfare and unity of all pensioners.

INBUILT DELAYS & INTRICACIES OF THE LEGAL SYSTEM COUPLED WITH UNHELPFUL & CALLOUS ATTITUDE OF LIC/GOI HAVE CREATED MISGIVINGS IN THE MINDS OF COMMON PENSIONERS, BUT WE KNOW TRUTH WILL TRIUMPH AND WE WILL GET FULL JUSTICE IN THE VERY NEAR FUTURE.

WITH BEST WISHES AND REGARDS

H K AGGARWAL

HK Aggarwal's comments to follow soon.

IT IS REALLY STRANGE THAT THERE HAD BEEN NO TALK WITH ME ON THIS SUBJECT TILL DATE EITHER BY MR MS MURTY OR MR GN SRIDHARAN STILL THEY ARE TAKING MY NAME.

THEY ARE TRYING TO TAKE CREDIT OF THE APPLICATIONS WHICH I HAVE ALREADY MOVED IN THE COURT FOR SEGREGATION OF THE DA/DR SLP AND UPGRADATION OF PENSION SLP AND MADE A REQUEST FOR IMMEDIATE IMPLEMENTATION OF THE JUDGMENT AND PAYMENT OF ARREARS OR AT LEAST FROM THE CURRENT MONTH AND DISMISSAL OF THE TWO SLPS.
NONE OF THE TWO HAS ANY SAY IN JAIPUR SLPS EXCEPT CREATING HURDLES. DELHI SLP, WHICH IS THERE, SLP CONCERNS ONLY DA/DR MATTER WITH WHICH I HAVE LEFT IT OVER TO THEM.  I AM MORE CONCERNED WITH UPWARD REVISION.

AS FAR AS EARLY DECISION IS CONCERNED IT IS TO INFORM ALL CONCERNED THAT EVEN FOR THE PRESENT SLPS ARE NOT FOR FINAL DECISION BUT ON THE IAs ALREADY PENDING. FURTHER MORE UNTIL AND UNLESS THE LEGAL REPRESENTATIVES  OF DECEASED RESPONDENTS ARE ISSUED NOTICES FINAL DECISION DOES NOT SEEM TO BE POSSIBLE.  IN CASE THEY WANT TO WORK TOGETHER THEY SHOULD NOT PLAY THE GAME AT MY BACK AS HAD BEEN DONE WHILE MOVING THE APPLICATION IN CHANDIGARH SLP, OF WHICH THERE IS NO INFORMATION FROM EITHER OF THEM NOR A COPY HAS BEEN GIVEN, IT WAS NOT THOUGHT THAT CLUBBING IT WILL CREATE PROBLEMS
FOR US OTHERWISE I COULD HAVE ALSO MOVED AN APPLICATION. I HAVE NOT BEEN PROVIDED WITH A COPY OF THAT APPLICATION TILL TODAY AND NOW THEY SAY MY CONSENT IS IN THE OFFING, REALLY STRANGE.

MY APPLICATION FOR IMPLEADMENT AND INTERIM RELIEF IN CHANDIGARH MATTER IS ALREADY PENDING SINCE APRIL. THEREFORE WHAT WAS THE NECESSITY OF MOVING ANOTHER APPLICATION?

SIMILARLY EARLIER ALSO MR GNS HAD FILED AN APPLICATION IN DELHI HC SLP FOR DEPOSIT OF THE AMOUNT DUE TOWARDS DA/DR ON THE LINES AS HAD BEEN DONE IN JAIPUR HC, KNOWING FULLY WELL THAT THE SAID DEPOSIT WAS NOT PROPER AND OPPOSED BY ME. MOREOVER, WHERE WAS THE QUESTION OF
DEPOSIT WHY NOT PAYMENT AND TO WHOM THE NAMES HAVE NOT BEEN GIVEN. THEY ARE CONFINING THEIR CASE TO THEIR ASSOCIATION ONLY AND THAT TOO WITHOUT GIVING THE NAMES IN RESPECT OF WHOM THE AMOUNT WAS SOUGHT TO BE DEPOSITED.  TILL DATE HE HAS NOT GIVEN ME A COPY OF THIS VAGUE AND AMBIGUOUS APPLICATION EXCEPT TO HINDER THE SMOOTH PROGRESS OF THE CASE UNDER WHAT CIRCUMSTANCES.

  • HOWEVER I AM READY TO WORK TOGETHER BUT IF THE INTENTIONS OF ALL THE PARTIES ARE FAIR AND CLEAR, LET THEM CONTACT ME AND TELL ME THEIR STRATEGY BEFORE I CAN GIVE MY CONSENT.

FOR IMPLEADMENT KNOWING FULLY WELL THAT DELHI SLP HAS BEEN CLUBBED WITH JAIPUR IT WAS PROPER FOR HIM TO HAVE PROVIDED ME A COPY OF THE PAPER BOOK SO THAT I CAN BE READY TO BEAR THAT ATTACK WHILE OPPOSING SLPS IN JAIPUR CASE.  BUT THAT HAS NOT BEEN DONE.
THIS SMACKS SOME ULTERIOR MOVE

KML ASTHANA

Mention in the SC for out of turn hearing

Dear Jain Sahib,

I hope operating from your sick room, you are keeping yourself abreast with all the news
pertaining to the LIC retirees.

  • You are aware that hearing of the LIC appeals against Jaipur Delhi and ChandigarhJudgements is stuck up in the Hoble Supreme Court at sr no 47--51 for about two months.
  • No body can be sure when exactly it will be taken up for hearing.Our advocate Sri Savla has suggested that we have a case for making a mention of our Case before the appropriate bench of the Hoble Supreme Court requesting for an out of Turn hearing. No guarantee that Supreme court may agree to our appeal. But it is worth making an effort.
  • The exercise can be more impressive and is likely to cut more ice if it is made jointly by all 3 Advocates representing Jaipur,Delhi and Chandigarh petitioners. Mr M.S. Murty sent a request to M/s Asthana and GNS inviting them to join the Chandigarh Advocate in his efforts.
  • I feel happy to inform that Sri GNS has confirmed that his advocate will  support us in the SC in our request for out of turn hearing.
  • It appears that Mr Asthana has still to make up his mind. To my request he wrote that he had his own plans. I don't know what his plans are. Our plan is open and simple. No strategic move or mystery.

You are the Executive Head of the Federation. Kindly persuade Asthana Ji to fall in line.
WE ARE BEING WATCHED. IT won't make a good scene a part of the FED not cooperating
with the other part while outsiders joining to support.

With best wishes.
Chhabra

Thanks, many many thanks !

It is nice that Sri GN Sridharan has responded to the call of Sri MS Murty for support to the prayer to
"Mention" of counsel, appearing for the respondents in CA no 6995 of 2013, though it is not clear whether he will go for strong similar prayer before the bench headed by Justice Dipak Misra.
It is felt that responding to this request by GNS and Asthanaji, if he so decides, may bring a fair chance of the Bench agreeing to for an out of turn hearing.
Last night, we from Kolkata requested GNS for extending his support.
Many many thanks to Sri GNS.

World's easiest quiz

Unified Approach - The Small First Step Forward ...

I am happy to announce that a proposal to make a “Mention” before the concerned Bench of the Hon’ble Supreme Court, requesting for ‘’out of turn” hearing of LIC’s Appeals” has received the required concurrence from Sri G N Sridharan. He discussed the move with his Advocate on Record, who in turn agreed to support the move, appropriately. Sri GNS did offer his analysis of the procedural and other implications which are very well received, being totally relevant.

Last sentence of the circular GN SRIDHARAN
had personally handed over to the Chronicle Editor.
Formal response is now awaited from Sri K M L Asthana, for a similar request made to him, which as per indications available, is in the offing. Once it is also received, preparations are on for the ‘Mentioning’ either on 24th or on 25th September, as the next day ie., 26th is the last working day before the SC goes on Puja vacation till Oct 7.

This move is being pursued seriously but with great caution. Unfortunately, hearing in the ‘normal course’ is not in sight (because our batch of cases is still at Sl No 47 as of today) and hence we are taking a chance to try a permissible course open to us. While our success (in getting an early definite date) depends upon the unfettered discretion of Justice Dipak Misra, (influenced by our own luck – I believe we have it in plenty), we are sure, no harm would befall when we make a passionate plea on behalf of the super senior citizens, many of whom are in their eighties.

More on the subject through these columns, on or around 24/25 September 2014.

Dear Comrades,

We furnish herein the next of UFBU Circular on the UFBU meeting and Talks with IBA held in Mumbai on 17th instant.  During the UFBU meeting, from AIBEA we have explained our position in terms of our General Council meeting decision that the settlement should be expedited and UFBU should adopt a practical approach to arrive at a mutually acceptable wage revision and keeping in mind all other demands raised by the Unions.  IBA informed that the next round of meeting will be held within a week.  We will take stock of the developments during further negotiations and take suitable decision to achieve our long pending wage revision settlement.
With greetings,
                                      Yours Comradely,

C.H. VENKATACHALAM
GENERAL SECRETARY

WAGE REVISION NEGOTIATIONS – UFBU CIRCULAR

The representatives of UFBU met at 11.00 a.m. to discuss and decide the strategies to be adopted in the negotiations with IBA.  It was decided that along with the percentage increase in its offer, other important issues like regulated working hours, 5-day week, improvements in pension related matters should be raised simultaneously.
In the IBA meeting, Sri Bhasin, who was the Negotiating Committee Chairman till the last meeting and now elected as Chairman of IBA introduced the newly constituted Negotiating Team of IBA under the leadership of Sri Rajeev Rishi, the newly appointed Chairman of Negotiating Committee.
Subsequent to brief introduction and completion of formalities, before commencement of negotiations on wage revision, UFBU raised the following issues
·         Compassionate Appointment Scheme:
While thanking the IBA for its efforts and being instrumental in getting clearance of the Government for introduction of Compassionate Appointment Scheme on the lines available to Central Government employees, UFBU sought clarifications on issues like eligibility, applicability with regard to death cases prior to 05.08.2014, etc., to which IBA conveyed that the matter would be referred to Government and necessary clarifications will be issued on receipt of their advices;
·         Accounts to be opened under Jan Dhan Yojana:
While appreciating and extending the support of UFBU to the initiatives taken by the Government towards extension of banking facility to all the people in the Country, UFBU expressed the following apprehensions:
§  The compromises on KYC norms may lead to opening of fraudulent accounts for which employees should not be held accountable;
§  The pressure due to the targets stipulated for opening of accounts are greatly affecting the regular banking activities and services to existing customers;
§  Due to the stipulation on timings for opening of accounts from 8.00 a.m. to 8.00 p.m., employees are forced to work beyond their working hours and are also under severe stress to achieve the stipulated target.
During the negotiations, IBA informed that the UFBU's demand of 25% increase in pay slip components is on high side and beyond the paying capacity of banks and insisted that UFBU should review its demand, to which UFBU responded as under:
Ø    IBA should substantially revise its offer of increase in pay slip components;
Ø    The other important issues like regulated working hours, 5-day banking, improvements in pension related matters, etc. should be discussed simultaneously and in a time-bound manner;
Ø    The meetings on negotiation have to be held regularly at frequent intervals ensuring expeditious settlement;
Ø    UFBU will have flexibility in its demand depending upon the response of IBA on all the above matters.
IBA assured us to schedule the next round of meeting within one week to discuss comprehensively on all the issues.  Comrades - every effort is being made by UFBU not only for expeditious conclusion but also for a respectable Tenth Bipartite Wage Settlement.  Let us continue to maintain our unity which would strengthen us in achieving our goals.  Further developments will be advised in due course.
