LIC SLP 8090/2014 -  LIC Vs Mahesh Chand Jain  -  
now stands dismissed by the Supreme Court.


You are aware of the historic victory of AIRIEF in partnership with Kozhikode Class I Officers’Assn, affiliated to AIRIEF, who diligently & valiantly pursued this case for 6 years 1st & after success by a Single Judge verdict, when LIC decided to go in for appeal, the 2 Member Bench also dismissed LIC appeal at Kerala HC. The Pay scales of class I Officers were revised from 1/8/1992 but for purposes of payment of difference of Gratuity, the Chairman had issued instructions to make payment only to the Officers who retired on and after 1/8/1994. These instructions were challenged in Kerala High Court.

Yet, LIC persisted in appeal to SC in the form of SLP. An SLP was filed before the Hon’ble Supreme Court which was converted into Civil Appeal No. 1289 of 2007 -  LIC of India and Others vs. Retired L.I.C. Officers’ Association and others. The plea of the LIC was that the Chairman has the power under Rule 51(2) to vary the date of application of some provisions of the Revision Rules. The Hon’ble Supreme Court has in its judgment dated 12/2/2008 repulsed the plea of LIC. That was after another 2 yrs, SC gave its historic judgement dt 12/2/2008 against LIC & awarding that Class I Officers retired during 1/4/1993 to 31/7 /1994 will be eligible for difference in Gratuity after implementing the then wage revision. So, it was saga of sacrifice for 6yrs, then 2 yrs all at Kerala HC & finally another 2yrs at SC, in all 10 years. From the level of SC, AIRIEF addressed itself to ensure uninterrupted & clear verdict & all appreciate the committed role played by us throughout all these endeavours.

It was a dream come true, but no mention was made about payment of interest. RIEA, Jaipur, quoting many cases urged LIC to pay interest from the day of Notification. So, too, AIRIEF wrote to Chairman, LIC. After follow up, came LIC CO Circular dt 18 March, 2008 for payment with SI of 10%, procedural matters & proof etc. spelt out therein. Such was the involvement that no time was wasted in pressuring management & all will agree this has resulted in a good bonanza for all eligible as SI of 10% allowed exceeds principal arrears totalling a respectable amount for the recipients. Sure, all the beneficiaries owe a deep debt of gratitude to Kozhikode Class I Officers Assn affiliated to AIRIEF for the singular historic victory with a final joyous culmination.

However, while implementing the judgment of the Hon’ble Supreme Court dated 12/2/2008 Central Office issued Circular Ref. Dept: Personnel/ER/A/G-68 dated 19/3/2008 but again a way has been made out not to implement the judgment of the Hon’ble Supreme Court and keeping the path of litigation open when it directed for payment of difference of Gratuity to only those who retired on and after 1/4/1993 but those who retired during the period from 1/8/1992 till 31/3/1993 have been arbitrarily discriminated and deprived of this benefit and equal treatment.
We were proud to announce that as a result of Civil Writ Petition 1128 of 1997 filed by our late Sri ML Gandhi (Retd Dy ZM) & Others for quashing Rule 9 of LIC Class I (Revision of terms & conditions) Amendment Rules 1996 re Gratuity, the Hon HC of Punjab & Haryana delivered verdict, in favour of the Petitioners, on 4/7/2008 at Chandigarh, quoting Hon Supreme Court Judgement dt 12/2/08 in Civil Appeal 1289 of 2007 with directions to Respondents to grant consequential benefits, irrespective of date of retirement, on revised pay within 3 months.

AIRIEF lost no time & late Sri ML Gandhi sent Memorandum to LIC Chairman stressing extending difference in gratuity payment to Officers retired between 1/8/1992 —31/3/1993 & to be on safe side filed Caveat Petition also on 3/9/08. Chairman has allowed & CO has issued instructions to pay difference in Gratuity with SI of 10% vide Per/ER/A/G-68/1 dt 19/9/08.  All those got substantial arrears, but paid some amount only not commensurate with efforts made by AIRIEF & some paid to other pensioners Federations unconnected with the case.

Remember the dogged efforts & acumen of AIRIEF when our RIEA, Jaipur spearheaded by Sri KML Asthana pursued the case to its logical conclusion & filed CWP 1454/2009 in the name of Sri M.C. Jain RM (Accounts) (Retd). After 3 years, Single Judge Hon Justice Bhandari pronounced vide his Order dt 13th September, 2012 that the petitioner has been declared entitled for revised pay scale as per Notification dated 18/07/1996 with consequential benefits. LIC went in for Special Appeal (Writ) 1492/2012. AIRIEF cannot remain silent. Sri Asthana pursued this with perseverance & without letup.This was a marathon effort & a masterstroke. Division Bench, Jaipur dismissed LIC appeal vide its succinct order dt 17/12/2012. It was full of flavor & victory to us.

Our advocate, Jaipur sent Contempt Notice to LIC Chairman, ZM, NCZ & SDM Jaipur to honour graciously & implement the order of the judgement . We prayed good sense will prevail, as earlier Supreme Court itself, in Gratuity case has given logic & sense and so it should be in the fitness of things LIC accepts gracefully. Will LIC ever do so ?

LIC filed SLP 8090/2014 which now stands dismissed by the Supreme court. I got it confirmed from Sri R.K. Singh this morning. He was categorical that SLP was dismissed. I even told him this, directly & indirectly adds enough strength to our case of pension upgradation with every wage revision. He also admitted the logic. When finally it comes through, with a LIC CO Circular, one will get arrears of Pay between revised pay & old pay with appropriate DA till date of retirement & Revised Pension on that new pay with arrears as difference in pension from DOR till date of LIC CO circular. AIRIEF GS will move in the matter fast, as soon as we shall get SC ORDER
TRUTH & EQUITY TRIUMPHED AT LAST.

Mind boggling achievement indeed. We are sure you all will appreciate AIRIEF concerted efforts with all your heart, as it is extraordinary & confers a very sizeable arrears to the beneficiaries.

LIC’s SLP (Civil) 16713 / 2014 has been reportedly dismissed by Supreme Court

1. As a result,LIC has to refix the salary of Mr M C Jain on 1/8/1992 and arrears of difference in salary have to be paid for the months from  Aug 1992 to March 1993;

2. Pension has to be refixed based on revised scale of pay from 1/11/1993;

3. Arrears of difference in pension from 1/11/1993 till date have to be paid.

4. Difference in commuted value of pension has to be paid on account of revision of pension;

5. Restoration of consequential difference in commuted value of pension to be done from the date of completion of 15 years from the date commutation became absolute;

READING BETWEEN THE LINES OF THE MC JAIN CASE JUDGMENT

Other Implications flowing from the judgment

1. These benefits will also have to be extended to similarly place retired Class I Officers & Class II Officers.

2. Even when refixation of pension is done from 1/11/1993,DR anomaly will persist which has to be removed in terms of the Jaipur SJB Order dt 12/1/2010 where re-fixed basic pension exceeds Rs 2400 ;

3. Salary revision will also have to be done for Class I pensioners & Class II pensioners who retired after 1/4/1993 w.e.f 1/8/1992 with consequential benefits like revision of pension ,if any;

4. In-service Class I Officers & Class II officers who entered the cadres before 1/8/1992 will also be entitled to the salary revision w.e.f. 1/8/1992 and arrears on account of difference in salary from August 1992 to March 1993 ;

5. In respect of Class I Officers & Class II Officers who retired after 1/4/1993 and died thereafter, the spouse/nominee will be entitled to difference in salary from August 1992 to March 1993, and difference in pension up to the date of death and also refixation of family pension as well as the arrears of family pension from the date of death of the retired officer.

6. In respect of family pensioners, where regular Class I pensioners & Class II pensioners retired between 1/8/1992 and 31/3/1993 expired during that period, Family Pension will also have to be revised besides payment of arrears of salary from 1/8/1992 ;

7. Also family pensioners where the officers entered the Class I cadre & Class II cadre before 1/8/1992 and continued in service till their death after 1/4/1993 will be entitled for arrears of revised salary due from 1/8/1992 to 31/3/1993, and revised family pension from the date of death of the officer;

8. The benefit of the judgment will also have to be extended to Class II Officers who became Class I Officers after 1/8/1992 


9. Interestingly, Class I Officers who were appointed to the post of MD or Chairman( from among Class I Officers in LIC) after 1/4/1993 will also be beneficiaries of this judgment.

NDA BUDGET 2% TDS ON INSURANCE POLICY PAYMENTS wef 1 OCTOBER 2014

From 1st October 2014, your insurer will deduct tax at source of 2 per cent from maturity proceeds of a life insurance policy if the premium paid is more than 10 per cent of the sum assured. 

Currently, under section 10(10D) of the Income Tax Act, any sum received from a life insurer is not taxable if the premium payable is upto 10 % of the sum assured. Tax would be payable as per your tax slab if the premium exceeded the 10 per cent amount. However, since there was no TDS, several assessees avoided the tax.

The finance bill 2014 states "In order to have a mechanism for reporting of transactions and collection of tax in respect of sum paid under life insurance policies which are not exempted under section 10(10D) of the Act, it is proposed to insert a new section in the Act to provide for deduction of tax at the rate of 2 per cent on sum paid under a life insurance policy, including the sum allocated by way of bonus, which are not exempt under section 10(10D) of the Act."

It has also been proposed that no deduction under this provision shall be made if the aggregate sum paid in a financial year to an assessee is less than Rs 1 lakh. In 2012-2013 the threshold of premium payable was reduced to 10 per cent of the actual capital sum assured from 20 per cent.

NDA BUDGET INCOME TAX & EFFECTS THEREOF‏

Finance minister Arun Jaitley has given reasons for individual tax payers to smile in his first Budget on Thursday as he raised the exemption limit of income tax from Rs 2 lakh to Rs 2.5 lakh for all individual tax payers below 60 years. For senior citizens up to 80 years, the exemption limit has gone up from Rs 2.5 lakh to Rs 3 lakh. There is no change in the exemption limit for senior citizens above 80 years.

He further raised the income tax deduction limit on investments in Section 80C

instruments from Rs 1 lakh to Rs 1.5 lakh. This was one of the long-pending demands of the investment communities.Under Section 80 C of the Income Tax Act, one can claim deduction from taxable income if one invests in Public Provident Fund (PPF), Employee Provident Fund (EPF), National Savings Certificate (NSC), life insurance policies, tax-saving bank fixed deposits, Senior Citizen Savings Schemes, tax-saving mutual funds and to repay home loan principal.


"The increase in basic exemption limit from Rs 2 lakh to Rs 2.5 lakh will benefit all the individuals. The increase deduction under Section 80C from Rs 1 lakh to Rs 1.5 lakh will help achieve twin objectives of encouraging the households to make long term savings, and also increase the overall savings rate in the economy which has fallen considerably over the last five years," says Vikas Vasal, Partner, Tax, KPMG in India.

The Budget also gave a major relief to home loan borrowers as it raised the deduction limit on interest paid on home loans for self-occupied properties from Rs 1.5 lakh to Rs 2 lakh. As a result of these changes, a taxpayer in the 30% tax slab can save up to Rs 36,050 a year, in the 20% tax slab can save up to Rs 25,750 and those in the 10% tax slab can save up to Rs 17,510.

"Given the rising costs of property and interest, a deduction of Rs 1.5 lakh on interest payments is insufficient. The Budget has proposed increasing the relief of housing loan interest from Rs 1.5 lakh to Rs 2 lakh for self-occupied house property is therefore a welcome move," says Tapati Ghose,Partner, Deloitte Haskins & Sells.The finance minister has, however, not given relief to those with annual income of more than Rs 1 crore as the 10% surcharge levied by the UPA government in last years budget will continue.

affecting Class 1 retirees alone peculiarly, one by one and step by
step.

We are glad that some of our Units have sent special contributions
called for by us for this purpose. The rest of the units are in the
process of sending the same. We request and expect them to expedite.

Dear Sh Gangadharanji,
Family members again express their thanks for the moral strength
they received thru messages from all parts of the country.
The prayer meeting of Sh SP Sood was over before 4pm. It was well
attended by over 1 K as all the three halls were full. People paid rich
tributes for his social works like Lab. clinics, Meditation centre,
Physiotherapy Centre in  Sood Bhavan - a three star type community
centre with rooms, library, canteen etc.
Lets now close this chapter with prayers to almighty for peace and
courage to all AS THE SHOW MUST GO ON.

Even when the critical condition of our bosom friend Sri.Sood was conveyed by Sri.Aggarwal, I could not believe the message as I used to receive his constructive comments then and there on my articles regarding our court cases and the differing views of our leaders towards their approach till some ten days back. 
I thought that it might be a temporary set back in his health. Sri Aggarwals latest communication about the nature of illness and the will power of Sri. Sood in fighting against the sufferings reveal his strong mind and his utmost care not to ventilate this cruel condition to his family members. 
Every one must have believed that Sri.Sood would recover from this ordeal somehow due to some occurrence of miracle. But he has disappointed us.We wish his soul rest in peace and we pray that Almighty to provide sufficient strength to the family members to bear this irreparable loss.

FAMILY FLOATER POLICY - CHANGES IN BENEFITS AND OTHER POLICY CONDITIONS

Dear Sir,

Group Mediclaim Policy for the year 2014-15 has been issued. Following changes in benefits and other policy conditions have been incorporated in the policy.

1. Room, Boarding Expenses as provided by the hospital including Nursing charges, should not exceed 1.5% of Compulsory Floater Sum Insured per day, subject to maximum amount of Rs.7500/- per day.
2. Expenses in respect of claim relating to Cataract shall be limited to Actual or maximum of Rs.60000/- for each eye, whichever is less. Old limit was Rs.40000/- for each eye.
3. In case of Maternity Expenses Benefit, the maximum benefit allowable for ‘Normal Delivery’ shall be Rs.65000/- (old limit was Rs.50000/-) and for ‘Cessarian Section’ the medical expenses upto Rs.125000/- (old limit was Rs.100000/-) shall be reimbursed.
4. Four additional Diagnostic Tests, i.e. Gastroscopy, Colonoscopy, EEG and EMG without hospitalization shall be covered.
5. One additional treatment (Organ Transplantation) shall be included for Cashless Facility.
6. The reasonable, customary and Medically Necessary Surgeon fee and Anesthetist fee shall be reimbursed, limited to the maximum of 25% of Sum Insured where bills raised by Surgeon, Anesthetist directly and not included in the hospitalization bill.
7. Fee paid directly to Surgeon/Anesthetist in cash will be reimbursed upto a limit of Rs.10,000/-.
8. Maximum amount payable for Lasik Laser treatment performed to get rid of spectacles and/or contact lenses shall be Rs.35,000/- per eye.

बच्चे तेरे निढाल शरीक-ए-हय्यात भी,

ला-इन्त्तेहा शफ़क़त से तुमने उनको नवाज़ा,

Both AIRIEF and Cl.I Federation must have studied and observed the various opinions and reactions to forge a united approach and present a unified understanding when they appear before the Supreme Court Bench on 12th August 2014.

has right to get protection from 
erosion of " real value," of pensions...
LIC Pensioners' Chronicle served a very useful purpose by providing space in its columns to diverse opinions  in this matter. What is at stake is not the fortunes of these organisations. It is the future of pensioners and their right to get protection from erosion of the " real value," of pensions, what with mounting price rise, ever increasing medical expenses etc. etc. 

From the days of Voltaire to Karl Marx, emphasis was laid on spread of ideas capable of bringing desirable change in society. " When ideas grip masses they become a material force," it was said. That is why in all epochs the ruling parties tried to suppress spread of ideas. The latest example is the results of the general elections held in 2014. It is simply astonishing that the entire country acted with one idea of overthrowing lock stock and barrel a dispensation which they perceived to be acting against the interests of common man. 

We have had sufficient airing of the good idea of UNITY. No doubt the air also carried some dust


storm, but that is part of nature. 

Now I feel the time has arrived for the decision making fora of both the organisations to evaluate the opinions and decide on the best course of action. That is how decisions are taken in a democratic way. If the decision making executive bodies of both organisations feel that a unified argument has to go before the Supreme Court, that would be welcome. If still they decide to go their own ways, the burden of explaining the rationale also will be with them. The leaders are not fighting their personal battles, it is the battle for all pensioners. 

In the next 35 days all of us would watch the direction in which these organisations make
decision. We have faith in them as the leaders have behind them decades of experience in decision making.

Just returned home after being part of cremation ceremony of our beloved friend Sh. S.P. Sood Secretary AIRIEF Unit, Chandigarh. Sh.S.N.Chhabra ,Sh.H.L.Kharbanda and Sh.H.D. Sharma besides many other honorable members from our Panchkula unit were with me.

Really it is extremely difficult to say final good bye to any of our near and dear with whom we have very very long association like in case of Sh.Sood with whom I was associated since 1991. A very large gathering today at cremation ground clearly proved popularity of Sh.Sood. After his retirement from LIC, he was associated with many social activities like being Secretary AIRIEF Chandigarh Unit and President of Sood Sabha in Tricity. But one thing is more than clear that Sh.Sood performed all his responsibilities with complete dedication and sincerity. His command over English drafting was superb.

I had a chance to be at his residence on 23rd March last to enquire about his health along with Mrs and Mr.R.B.Kishore as well as Sh.B.Angurajan and Sh.H.D.Sharma and he was looking quite cheerful at that time. But as we all know that Life is very uncertain and we humble human beings are helpless before the Will of God.


Final Prayer Ceremony or Rasam Uthala is to be held at Sood Bhawan,Sector 44, Chandigarh on 10th July Thursday from 2.00 pm to 3.00 pm.

Let us all pray to God to grant peace to departed noble soul and courage to bereaved family to bear this irreparable loss.

REMEMBERING SP SOOD

Friends,

*I received the sad & shocking news of the death of our
beloved friend Sri SPSood, Chandigarh Sri VCJain spoke to
me. A Stalwart of RIEA CGH, a true Activist in every sense,
a AIRIEF loyalist is no more. He was an ardent pensioner
following in continuity all the legal proceedings in minute detail.
He was a thinker, offerred many suggestions for pensioners
welfare. He was such a fine ,committed activist, he alongwith his
colleagues & OBs collected substantial donations for the legal fund.
They arranged a meeting with the then Sri Pawan Kumar Bansal,
submitted a Memorandum of pensioners. They even sought their
associated known advocate & his expert opinions were sent to
Sri Asthana.
**Sri SPSood was a fluent writer in English, Hindi, Urdu 
couplets with English translation. He exhibited a balanced 
temperament. We, myself, Mrs Seetha Kishore, Angurajan, BRMehta, 
HDSharma met him & his family on March 23,2014. Mrs Kishore 
presented a portrait of Shirdi Sai Baba & sacred ash,even 
earlier I sent 4 line Mahamruthinjaya stotra to be recited 10 times 
twice a day for which he was very thankful.I used to send some 
clippings from Madras Cancer Institute to him.He replied his 
illness comes under a different category.

***Sri BRMehta told me just now that yesterday S/sri SNChhabra & CMBhargave went to the private hospital where he was admitted. Breathlessness in spite of oxygen mask deprived him of breathing & today evening, he passed away. The news is shocking & unbearable. We are unable to believe this as March witnessed a recovery but last few days the situation aggravated & deteriorated.

****I recall the 3rd inside Cover Page of KURUKSHETRA Booklet 
where, among many couplets he used to liberally & forcefully 
sprinkle,this adorns & how meaningful & true it is :
As Asadullah Khan Ghalib has so aptly put it,
"Rau mein hai raksh-e-umar kahaan dekhiye thhamey
Nai haath baag par hai na pa hai rakaab mein"
Age travels at galloping pace: who knows where it will stop.We do 
not have the reins in our hands nor our feet in the stirrups ---S.P.SOOD

CONTEMPT PROCEEDINGS IN PUNJAB & HARYANA HC, CHANDIGARH‏

The matter came up today before the Court. M/s Brij Jit Singh and S N Chhabra were present in the court on behalf of the Petitioners. Chief (Legal) from Central Office attended the hearing.

LIC counsel informed the Court that the Corporation was making necessary calculations of the amounts payable to the Petitioners (presumably in response to the demands made by the Petitioners earlier through a legal Notice) and that they will deposit the money in the Court in six weeks time, along with the supporting calculation sheets. The petitioners may thereafter apply to Court and withdraw the amounts.

After recording the above undertaking by LIC. High Court posted the matter to 27th January 2015.

This information has just been conveyed to me on phone by M/s Brij Jit Singh and S N Chhabra.
