BASIC, FUNDAMENTAL PRINCIPLES AND POSTULATES - A RUNNING COMMENTARY OF SALIENT & SAGACIOUS ARGUMENTS FOR REBUTTAL OF UOI AFFIDAVIT, DISMISSAL OF SLP 29956 & 29957 OF 2011 AND TO CLINCH VICTORY IN SC AND JAIPUR HC.

SOME SAY IT IS A GRIM BATTLE, SOME FIGURE IT AS ‘FIGHT TO FINISH’,SOME SAY THIS WILL BE THE LAST OBSTACLE TO BE CLEARED TO GAIN PENSIONERS' SO-CALLED MISSION OF PENSION UPGRADATION WITH FULL DR FOR ALL — A REAL KURUKSHETRA BATTLE.

i) a) Delayed reaction from Government to sabotage our case and cause. Union of India (UOI) was represented by their Counsel during SJ Jaipur HC submissions. UOI COUNSEL HAS ACCEPTED THAT MATTERS OF PUBLIC POLICY ONLY NEED UOI APPROVAL. AFTER DETAILED, THOROUGH, PROLONGED DELIBERATIONS AND DISCUSSION ONLY, PENSION RULES, 1995 came into being.  And so, any other aspect within such Rules promulgated, LIC can take decisions and then proceeded to finally announce verdict of pension revision substituting scales of pay after wage revision. Even after Notices were issued to UOI, they never went in for Appeal. GoI was not a party to any Appeals or Reviews either in the Rajasthan High Court or the Supreme Court. We should take a strong plea that the Affidavit submitted by the GoI must be rejected and not even allowed to be argued at all.

Fight to the finish is required. DB Judges, Allahabad questioned LIC Counsel in earlier years sitting in May, 2011, when LIC Counsel accepted LIC is prepared for pension revision and full DR.  Earlier, in Jaipur case, when DB Judges asked LIC Counsel, why delay for 10/11 years, are they happy with thousands of pensioners death, LIC Counsel admitted 'Sorry'.

Jaipur DB judges asked and confirmed after LIC Counsel's positive reply (no withdrawal of LIC Board Resolution), the eminent Judges told, you can’t withdraw, we will not allow you to withdraw, it is now common property of Rajasthan HC. WHEN SUCH IS THE CASE, UOI wants to put the clock back.  IS IT NOT RELEVANT, PENSIONERS?  UOI SHOULD NOT EXHIBIT DISREGARD.

b) We should adopt all means, strategies, clever interpretation, forceful depiction, pathetic conditions of pensioners, majority above 70 yrs with ailment and diseases, PORTRAYED, LIC and UOI jointly killing the mind and mood of pensioners, with dilatory tactics, delay, flimsy grounds, especially in an egalitarian society and a democracy, respect to Elders and Sr Citizens and such noble values always upheld, whereas UOI always wants to establish its supremacy, unwanted interference in working of institutions, ESPECIALLY CREDIBLE, CREDITABLE and UNIQUE and NOTEWORTHY institutions of reputation and goodwill - LIC, strange and shocking!

c) When all promises are kept, when LIC has donned such a powerful and instrumental role in nation's economy, helped Govt to stabilise stock markets, lend tremendous assistance by way of Social Security for Aam Admi, inclusive growth and above all such a sterling contribution to Govt 5Yr Plans, Peoples Money for Peoples Welfare, in almost all sectors of people and society and nation development, and when Pensioners for long yrs 35 and more have done yeoman service and built foundation, erected fine superstructure, ably galvanised with Reorganisation in the 80s MADE THE INSTITUTION BEAR INTENSE COMPETITION WITH CONFIDENCE AND COURAGE, SUCH a Paltry pension, shame on the institution for no fault of pensioners. GOVT REGULAR PENSION IS FAR FAR HIGHER FOR COMPARATIVE CADRES. Many are not aware that even Govt Family Pension is higher than LIC Regular pension, even with all these facts, figures, reason and logic, public tribute  standing, and unqualified praise from FM and PM, it is disturbing that Pensioners should be treated so bad, UNWEPT, UNHONOURED & UNSUNG

TALKS WITH DIRECTOR (PERSONNEL)



In keeping with the policy of striving for redressal of the problems faced by older age group among pensioners on priority basis I had today (20-7-2013) a detailed discussion over phone with the Director (personnel) in regard to the Re-fixation of pension for the following 2 categories viz (1) those who had Retired between 1-8-92 &1-4-1993, and (2) Pensioners whose date of birth falling on 1st of calendar month. 
We have strongly pleaded that the issue should be decided by LIC itself without involving the Government. The Director(P)appreciated my stand and I hope a favourable decision will be taken soon.

LIC CLASS I (Retd.) Officers' Association, Chandigarh Unit vehemently condemns the  tirade being carried out in the name of freedom of expression.  
  • In fact some individuals are out to serve clandestinely LIC & GOI. They are in fact messengers of doom who are out to create frustration and sabotage pensioner's unity. Why should they feel turmoils in their tummies if pensioners hope that Hon'ble SC will do justice and uphold the Orders of Rajasthan High Court (Single Bench, Division Bench & dismissal of LIC's Review Petition followed by Pb.& Haryana High Court judgement).  
  • We are fully aware that even after the SLP is dismissed it will not be a smooth sailing because LIC with the backing of GOI will try their  level best to somehow deny the benefits to LIC Pensioners. We have such apprehensions after reading the contents of the affidavit filed by MOF, GOI. But It does not mean that we should surrender. 
  • Legal battle has to be fought because THERE WAS NO OTHER ALTERNATIVE and Sh. Asthana has shown us the way.  Now we will sail or sink together.

  • 4) I INFORMED THAT RECENTLY LIC ALLOWED MONTHLY RS 1000 EXTRA FOR EX-GRATIA RETIREES & THIS IS A VERY PALTRY AMOUNT, I ADDED, IN THE CONTEXT OF SOME BANKS AND RBI ALLOWING MANY REVISIONS & SUBSTANTIAL RS.3500-RS.6000 PM AS MONTHLY MEDICAL ALLOWANCE. MORE SO WHEN THE TRIBE HAS VIRTUALLY DIMINISHED SO FAST FROM 5500 TO A MERE 950, IT WAS SHOCKING SUCH A MEASLY BENEFIT WAS PROVIDED,WHEN GIANTS LIKE FORMER ESTEEMED LIC CHAIRMAN SRI J MATHAN GET SUCH POOR RS. 300 + DR ALL THESE YEARS.
  • 5) I TOLD HIM THAT GOOD PROFESSIONAL HELP HE ALWAYS GAVE ME AS AN INVESTMENT EXPERT WHEN I WAS NOMINEE DIRECTOR IN SOME COMPANIES WHILE IN SZ, EZ AND SC ZONE.

UTTARAKHAND DISASTER RELIEF EFFORTS CONTINUE...



With a feeling of sadness that cannot be expressed in words, we pen a few lines....  We know these feelings and words will not be able to recompense lost lives.  None can ever imagine Mother Nature can be so furious as She was recently in Uttarakhand and Himachal Pradesh causing of loss of precious lives and causing such devastation.

Torrential rains in the mountainous areas flooded the rivers that swept  away people, that uprooted the buildings in the vicinity, that changed the whole landscape of the area....

Dear Sh PG Gangadharan

LIC PENSIONERS CALICUT  blog had carried excerpts of a circular issued by Federation of Class I Officers Associations. While all have the right to express anything and everything, but before making any sarcastic remarks one must see below his belt. 

The court cases have definitely given the pensioners all hopes. May I ask the Fed of Cl. I officers what they have GIVEN and done to get the retiral benefits. If they have a solution (other than court) why they have not been able to get anything from the management ? They should have got and all will be happy and obliged too to them for the same. But by simply making excuses and blaming others is not going to get them any thing, except some ego satisfaction to the leaders and a pat from the management. Such moves do more harm to the common cause.

Finding Advocate on Record (AoR) Rameshwar Prasad Goyal not present in the court despite repeated calls, a Bench of Justices B.S.Chauhan and S.A.Bobde issued a show cause notice to him

CIRCULAR DATED 10-7-2013 ISSUED BY FED. OF RETD. CLASS I OFFICERS ASSOCIATIONS



The Special Leave Petition against Judgment of Punjab & Haryana High Court stands adjourned by two weeks  - Writ Petition before Kerala High Court will be listed before the end of this month.  

The circular dated 10th July 2013 of the  Federation of Retd. Class I Officers Associations also says: "It is an undeniable fact that right from January 2010 pensioners have been made to live on hopes that the pending SLPs would be decided in our favour.  No doubt, we shall definitely be happy if they are dismissed but actually the situation is getting more complicated."

CHANGES IN GROUP MEDICLAIM POLICY FOR 2013-14




CIRCULAR

Members will be aware that the Central Office had recently introduced some changes/improvements in the Group Mediclaim Scheme.  Since some members have sought the details, we furnish below the salient features of the relevant Central Office circular.

  1. Cashless facility has been extended for specified treatment/surgeries as follows:- Cancer, Renal Failure & Accident Trauma Cases (Treatment/Medical management/Surgery) and Cardiac disease & Neuro Ailments (surgery).
  2. Waiting period of one year in case of claim settlement for optionally increased sum assured to take care of a particular disease or for a planned surgery has been removed.
  3. Treatment for fracture/dislocation (excluding hairline fracture).  Coronary Angiography/Angioplasty requiring hospitalization less than 24 hours has been allowed under Hospitalization Benefit.
  4. Unemployed children age upto 25 years, whether he/she is pursuing whole time studies in recognized educational instituion or not, will be considered as dependent children.
  5. Present limit of refractive error (-7) has been reduced to (-2) for providing mediclaim cover for Lasik Laser treatment to get rid of spectacles and/or contact lenses.
  6. Waiting period of nine months for the reimbursement of Maternity Expenses has been removed.
  7. In case of Caesarian Section Delivery, limit for the reimbursement of maternity expenses has been increased from present limit of Rs.50,000/- to 1,00,000.
  8. Expenses in respect of new born child, during the delivery confinement period in the hospitalization has been allowed to be reimbursed upto the mother's sum assured instead of present limit of Rs.50,000/-.
  9. The amount reimbursable against expenses relating to Diagnostic Tests without hospitalization has been increased from Rs.15,000/- to Rs.20,450/- per insured.
  10. Grievances redressal cell or Appeal mechanism, has been specifically built for insured who feels that the claim is wrongly repudiated by the insurer's claim servicing office. To read more, please click below.


Court orders fall into deaf ears

Taking cue from R.B.Kishore who wrote : “ Justice Rathore dismissed contempt petition…In all these cases we were not able to appreciate the order. There is something wrong with the judges or with us,” I am inclined to quote what Justice Kirubakaran of Madras  H.C. has observed.

When the State Government has not complied with the court order to spell out the steps it has taken for curbing the acid menace, Justice Kirubakaran observed : “ Who is afraid of court orders ? Orders fall into deaf ears. Authorities show no intent of compliance. Disobedience of court orders strikes at the very root of the rule of law on which the judicial system rests. This situation exists because either there is no fear among officials about contempt proceedings or they are not made aware of the negative consequences of non-implementation of  the judicial order.  Who should instill that fear and who should make contemnors aware of the negative consequences is a million Dollar question. Can any one answer this ? !

THEY ALL DEPARTED TO SEE THE END OF THEIR WOES AND MISERIES

It is heart-breaking to hear the news of death of our esteemed pensioner friends here and there within a few months in our Madurai Unit of RIEA.   

  • A couple of months ago D.Devaraj, AR.Valliappan & V.D.Viswanathan left us  without witnessing the final outcome of our struggle for neutralisation of DA & revision of pension, though they were enquiring about court cases day-in and day-out.  They never missed to question whether they could smell that carefree breeze within the span of their life time.  
  • One can imagine how those questions could have been responded. Recently our Jt. Secretary A. Anandhakrishnan passed away much unexpectedly. This morning yet another sad news was conveyed by Sri.Venkatasamy that our elder member A. Rajaguru passed away yesterday night by about 10-30.  
  • Paucity of sufficient funds at this advanced age to meet out the obligations of the family and the society, being the head of the set-up, oppressed by mental stress and strain generally lead to this sudden break of life journey. 
  • We could only pity and mourn. It is only in the hands of ALMIGHTY to reverse the trend that prevails in the air-conditioned cabins of Powers That Be. 
  • Let us all unitedly pray God to pardon their wilful sins and bless them.

These are comments on judges. We have appreciated Justice Bhandari's judgment. Thereafter we appreciated DB judgment. Also,we congratulated the Judges who heard Review Petition. Then when LIC approached the SC, we appreciated the order of SC asking the petitioners (LIC) to deposit the amount due to the employees.   
While we were grateful,thankful and glad too about judgments and orders issued by these judges, it has not been possible for us to have a positive and constructive look at orders issued by judges thereafter.

Supreme court revised its earlier order and asked the petitioners (LIC) to deposit amounts in respect of petitioners in the Rajasthan HC only, thereafter court said, no case is made out etc. hence the petition is dismissed, again in Rajasthan HC, Justice Rathore dismissed contempt petition... in all these cases, we have not been able to appreciate the orders. Then we started a hectic campaign, sometimes, against judges.  There is something wrong with the judges or with us or with the way we look at things. Shri KK Sheri said: "BACK TO HIGH COURT...HOW DOES IT WORK ?   We are now fighting for a contempt petition in High Court after having withdrawn the same in the Supreme Court.  How does it work?" 
  •  I wish one from among us had written a model judgment admitting the contempt petition citing his reasons for the information of Justice Rathore and SC !  I know I will be more acceptable if I follow the trend of shouting from rooftops there's something wrong with our judicial system, but I would venture to say, we cry halt to this tendency and better revise our strategies in the court looking to our strengths and weaknesses.

and the third, just joined !

Shri ANGURAJAN, Organising Secretary, AIRIEF, had issued a statement that the Chairman had agreed, among others, the following (very simple) points. " Pensioners Portal - Chairman gladly agreed to the same. It is believed; portal will serve several purposes and will be helpful to Office, pensioners and pensioner organizations. Nodal Officers - Chairman said that it is there already.  The OS Managers at all levels are Nodal Officers.Deduction of Group Medi-claim premium from Pension.  Some Divisions are deducting lump sum, some from 3 months pension, many from 6 month pension and in some  Zones/Divisions; no such practice, so compelling pensioners to pay in full before 31 March.  Chairman may be pleased to issue a uniform order. - Chairman said we will implement it soon."
  • We are yet to hear about any order issued by the Central Office in these matters.  We should have periodic discussion with the management.  Pensioners are entitled to know what happened thereafter.

POLITICALLY POLLUTED ENVIRONMENT



IT IS AN IRONY OF FATE THAT OUR POLITICAL PARTIES, BOTH NATIONAL AND REGIONAL, ALL HAVE FORGOTTEN THE BURNING ISSUES FACING THE COMMON MAN.  THERE  IS UNRELENTING &   INEXORABLE RISE IN INFLATION, CORRUPTION, SCAMS, CRIMES, RAPES, MURDERS, NAXAL ATTACKS, OTHER ECONOMIC OFFENCES THROUGH OUT THE COUNTRY, BUT NONE OF THE PARTIES, CENTRAL OR STATE GOVERNMENTS ARE SERIOUS ABOUT THE REAL PROBLEMS, AND  THEY ARE FULLY ENGAGED IN THROWING MUD ON EACH OTHER OR THEIR LEADERS BY LAUNCHING  VERBAL VILIFICATION  COMPAIGNS.

PERHAPS EGOISM IS OVERRIDING POLITICAL LEADERS' GOOD SENSES AND THEIR EYES ARE PRESENTLY SHUT ON REALITIES OR THEY ARE KNOWINGLY DIVERTING THE ATTENTION OF THE PEOPLE FROM REAL PROBLEMS. Competent and capable judges !

swears to act not.
- yes,he is a competent judge!
Why do some times the quality of judgments suffer? The Lawyers in the Madras High Court are agitating for appointment of good and competent judges as it appears that the names proposed for the next batch of appointments appear to have been made on extraneous criteria such as cast, religion, office affiliations, political considerations and so on.

The constitution never contemplated any executive function to be entrusted to judges except to the extent of appointing their own staff. 

Of late we have seen how certain orders passed in civil suits relating to LIC pensioners lacked clarity and the ball being tossed from one court to another giving rise to delay and anxiety.

IS LIC REALLY AUTONOMOUS ?


The story of private insurance companies functioned in the country prior to 1956 forgotten - so also "Mundra deal" and Justice MC Chagla Commission Report.... - Nationalisation of insurance companies in India - formation of Life Insurance Corporation of India - now all part of history...

Justice MC Chagla’s observation in the Mundra deal :- The government should not interfere with the working of an autonomous statutory Corporation. LIC is an autonomous Corporation independent of the Government and it cannot be looked upon as merely as one of the many departments of the government. The only control the government can exercise is under Sec 21 and that control is restricted to matters involving public interest and what is equally important is that the control can only be exercised by directions given in writing. Does this situation really exist now ?



The 5th pay commission clearly states that autonomous institutions can have their own pension scheme provided their funds are adequate. LIC pension scheme is clearly funded by LIC and unlike the pension scheme of government employees is not a burden on the exchequer and at no point of time LIC pleaded for inadequacy of the fund. Why then suddenly this so called ‘ripple effect’ in banks has cropped up ? Where is autonomy then ?


The tinkering of pension rules now and then, by GOI and dictated to the unfortunate LIC which merely remains as a silent spectator with no guts to question its rationale,  only shows that the GOI wants this overgrown, gigantic financial institution which was once described as a Navarathna, a Kamadenu and what not by the present Finance Minister to function as one of their own government departments for their own benefit coming to their rescue whenever they need finance in gigantic proportion which any other institution could seldom provide but yet forget those army of LIC work force who have contributed for its growth and success. Is this not raping the autonomy ?!

1) YES, IT LOOKS TO BE "WILFUL BLINDNESS" ON THE PART OF HON JAIPUR HC, NOT TO HAVE GIVEN & PRONOUNCED VERDICT & ORDERS TO LIC TO HONOUR HON SJ BHANDARIS JUDGEMENT ON PENSION UPGRADATION WITH FULL DR, SAME AS THAT FOR EMPLOYEES, DEALING WITH SRI ASTHANAS APPLICATION WHICH HAS SET FORTH CLEARLY WHAT FOR THIS APPLICATION IS MADE WITH COGENT REASONS & LOGIC.

2) BUT WHAT TO DO, JUST AS - THE KING CAN DO RIGHT & NO WRONG, WE CAN DAMN THE GOVT BUT CHEER THE KING  -  HERE TOO, THE HON JUDGES CAN DO RIGHT & NO WRONG, WE CAN DAMN THE PETITIONERS BUT CHEER THE JUDGES !!

WE KNOW THE COURSE OF JUSTICE NEVER RUNS SMOOTH BUT THIS IS NOT THE WAY TO KEEP ON LINGERING, EVEN AFTER SUCH A LONG & MEANDERING COURSE BUT WITHOUT ADDRESSING TO THE KERNEL OF ISSUE OF PENSION REVISION WITH SUCCESSIVE WAGE REVISION, ---

  • ALREADY DECIDED CLEARLY BY HON SJ BHANDARI &
  • TESTED IN DB JUDGEMENT,
  • WRIT REVIEW OF LIC DISMISSED,
  • FOLLOWED BY A SPATE OF CHANDIGARH & HARYANA COURT,
  • DELHI HC, & OTHER CONNECTED & RELATED
  • DELHI HC VERDICT TO CG EMPLOYEES TO PAY ARREARS TO EARLIER GROUP OF PENSIONERS TOO WEF 1/1/2006 NOT 1/1/2012 AS WRONGLY DECIDED BY CG/MOF, WITHIN 2 MONTHS FAILING WHICH WITH PENALTY OF 9% INTEREST.
  • EVEN MADRAS HC JUDGEMENT THAT PENSIONERS DIVIDED INTO HETEROGENEOUS GROUPS IS OUTRIGHT DISCRIMINATION,VIOLATIVE OF ARTICLES 14 & 16 OF CONSTITUTION.
