Confusion ?

FOR  CONSIDERABLE TIME, WE HAVE EXPERIENCE THAT NEITHER LIC HONOURS  HC VERDICTS  NOR EVEN  HC/SC TAKES ANY FIRM DECISION GIVING CLEAR CUT ORDERS TO  LIC. 

UNDER THE CIRCUMSTANCES, HOW LONG WE SHALL WAIT FOR JUSTICE ?  WE HAVE NO WEAPON LIKE "STRIKE".

  • WE ARE ON " RAM BHAROSHE " UNDER THE CIRCUMSTANCES.  I  BELIEVE THAT WE MAY CREATE A  SITUATION SO THAT WE CAN NEGOTIATE WITH THE LIC MANAGEMENT AS IT DESIRES TO REMOVE DA ANOMALY OF LIC RETIREES BUT DOES NOT AGREE FOR RETROSPECTIVE EFFECT. 
  • WE MAY ACCEPT SUCH OFFER WHICH WILL INCREASE ENTHUSIASM OF RETIREES. WE ARE 70/75 PLUS. I REITERATE - HOW LONG WE SHALL WAIT FOR JUSTICE? 
  • BETTER WE MAY NEGOTIATE AND GET BENEFIT EVEN IN PIECEMEAL AT INTERVALS.  LOOKING TO OUR AGE FACTOR, INSTEAD OF LEGAL PROCEEDINGS, WHICH AS SEEN RECENTLY IS LONG WAY,  BETTER WE CHOOSE ALTERNATIVE STEPS WHICH IS IN MY VIEWPOINT - NEGOTIATION WITH LIC MANAGEMENT AND GET BENEFIT TO PENSIONERS - NO MATTER, EVEN IF WE DON'T GET  ALL BENEFITS AT A STRETCH.

AFTER THE JUDGMENT IN SHRIDHARAN'S WRIT PETITION IN DELHI HC, THOUGH THE HIGH COURT HAS GRANTED IN THEIR WRIT PETITION NOT ONLY DR NEUTRALISATION AT 100%  BUT ALSO REVISION OF PENSION BUT STILL HE IS CREATING HURDLES IN OUR WAY BY WRITING TO CHAIRMAN AND CENTRAL GOVERNMENT TO REFIX THE PENSIONS AT WHAT THEY WERE GETTING ON 1/8/1997 WITHOUT UPDATING THE DR EVEN TO 100% AND ALSO WITHOUT FURTHER REVISIONS OF PENSIONS AS WE HAVE GOT.

“The Management is well aware of the refrain of the AIIPA stressing the need to find an early solution to the twin issues of increased ex-gratia to pre-1986 retirees and full neutralization of dearness relief for August 1997 retirees”.  So says the letter dated 10th June2013 of the General Secretary of AIIPA to the Management of LIC.

The letter also says the top officials of L I C indicated that the Government was favourably disposed to look into the increased ex-gratia to pre-1986 retirees and full neutralization of Dearness relief to pre August 1997 retirees along with the gamut of other issues.

Sri Natarajan further says, ”Our fond hopes for settlement along with wage revision for in service employees vanished into the air”. The gamut of issues and how they are vanished into air are only known to Sri Natarajan because transparency is an age old policy and not a virtue at present. The AIIPA has been representing to find solutions without need to wait for judicial verdict as only legal nuances and the merits of the issues were being agitated upon. This means, according to Sri Natarajan, the issues now engaging the attention of the Rajasthan High Court and the Supreme Court have no merit. It is obvious that Shri Nartarajan is oblivious of the Interim order of the Supreme Court dated 14/11/2011 and clarificatory order of the same court on 17th Oct 12 on the basis of the main prayer before the Supreme Court.

L I C prayed for an interim order staying on the operation of the final judgment dated 18/8/2011 of the Rajasthan High Court dismissing the review petitions filed by L I C. LIC further requested the Supreme court to confirm this order in the final verdict on special leave petition. The Supreme Court ordered for payment of amount due to the employees on 14/11/2011.The amount due was clarified and date from which they are entitled to payment were stated in the clarificatory order of Supreme court dated 17/10/12. 

It is not pertinent for Sri Natarajan to point now about the issues in which the resolution was based. According to him:“The resolution of the LIC Board in Nov 2001 clearly indicates mind set of the Management for the grant of Uniform rate of Dearness relief both for Pre Aug 1997 and post July 1997 retirees. 

He then demands payment of Dearness relief to pre Aug 1997 from 1st Aug 1997 and not from their date of retirement. Let us see what the Division bench of Rajasthan High Court has observed on 21/1/2011 while dismissing the appeal of LIC on Justice MN Bhandari’s Judgment. It says,”The Board of LIC, who is the appellant before us against the judgment of the learned single judge, had itself taken a decision to remove the disparities and the discrimination with regard to the payment of DA and pension to the retired employees under its resolution dated 24/11/2001,which was in public interest. It is clear from this that the resolution of the Board was for removing Anomaly in the DA formula and also up gradation of Pension.

The understanding of Sri Natarajan has become warped and awry with too much understanding of the mind set of the Management.

Now, Sri Natrajan please answer these questions:

1) Do the order of the Supreme court on 4/11/2011 and the clarificatory order Dated 17/10/12 in any way affect the order dated 12/10/2010 of Sri MN Bhandari.

2) Where do you stand now? On the side of LIC or L I C pensioners who have steeped into late 70’s and about to reach early 80’s. They know the Nuance of Legal Terminology and are able to see clearly the final victory in near future. This will happen in spite of your occasional pronouncements.

BANKING AND INSURANCE







Govternment's attitude on LIC pensioners' problems
 
- I refer to the extract from the Govt's affidavit posted in your blog couple of days back.





The highlighted point in the post is that the govt has taken the stand that it is their policy to treat Banking & Insurance as one unit in
all matters concerning employments, pensions etc. and consequently cannot decide even on DR anomaly faced by LIC pensioners in isolation from Banks. 





This stand may have come as a revelation to your correspondent. Mr. Asthana's supporters had bitterly criticised me when in my circular in Sept 2012 I had cautioned the pensioners 
GOVERNMENT AFFIDAVIT
that this clubbing policy of Govt. will be the biggest stumbling block. 





These friends should therefore understand that even judiciary will not direct change of policy which is the prerogative of the executive. This can be broken only by hard canvassing by combined efforts of all. 
  • The theory of everything for everybody through dismissal of SLPs must be kept aside and all should work for atleast some relief on DR 
  • The question however is whether all organisations of in service and Retd. Classes can come together at this critical hour? 
  • May God save the LIC pensioners !

AND IBA APPROVAL


Under Secretary, Ministry of Finance, Government of India,  in his counter affidavit brought a new point saying that the Board resolution needs the approval of IBA ! And, as the pension rules are common for Insurance and the Banking industry, the implementation of the LIC Board resolution would create a ripple in the banking industry. Strange! These points never figured either in the earlier affidavits nor they were brought in any of the arguments before the courts.



In the letter dated 31-12-2001 addressed to the Jt. Secretary Insurance and Banking, GOI by ED (PER/HRD-OD/OIC) none of the above points were raised, instead recommended notification giving effect to the recommendations of LIC Board resolution and all these years the bogey of IBA approval has never been brought.

All the ongoing suits in several courts relate to the pensioners being divided into different classes and treated with injustice, discrimination and arbitrariness giving rise to anomaly in DR and denial of revision of pension, etc. 

The legal issues are with regard to certain pension rules idiotically and fancifully framed which has blatantly contradicted the fundamental rights of certain class of pensioners as guaranteed in the constitution and, as they have surfaced and become transparent, requires urgent attention and rectification. In all fairness it should not be scuttled under some pretext or other. 

Further it is clear and understood that only constitutional or legal issue which was not properly interpreted by HC and raised for the first time alone can figure in the affidavit. Therefore the so called ripple effect and on top of it the IBA approval for the Board resolution could at best remain only as words which does not deserve any attention as they are deliberately manufactured to digress the court proceedings.
To whomsoever it concerns ignorance of law is no excuse.

EXTRACT FROM FINANCE MINISTRY'S COUNTER AFFIDAVIT...



You have very forcefully and in a legally sound way echoed the just demands of Bank Retirees. It is an irony of fate that LIC RETIRED EMPLOYEES ARE ALSO SAILING IN THE SAME BOAT INSPITE OF THEIR HAVING WON THE LEGAL BATTLE IN A NUMBER OF HIGH COURTS. PERHAPS YOU MAY BE AWARE THAT GOI (MINISTRY OF FINANCE) IN A RECENT COUNTER AFFIDAVIT SUBMITTED IN THE SUPREME COURT IN MAY,2013 HAVE REFUSED TO HONOUR THE JUDGMENTS ON THE FOLLOWING GROUNDS, (which are totally baseless,unconstitutional, speaks of arrogance on the part of FM.). 

FINANCE MINISTRY'S COUNTER AFFIDAVIT

  • "(VI)That the above proposal was considered in the Department in consultation with Banking division who had informed that any modification with regard to upgrading or change in the dearness relief formula in the insurance sector may have repercussion on public sector Banks as well as other financial institutions and advised this Division not to agree to the request made by LIC and to continue to maintain parity with regard to dearness relief with the public sector Banks. Hence, the proposal of LIC as per their Board Resolution was not agreed to.
  • vii)That on this issue, replies were also given by the Finance Minister to various reference from Members of Parliament stating that “the insurance employees pension rule is broadly based on the pension rule of banks employees and since no change has taken place in the pension rule of the bank employee, it would not be appropriate to change the rule for the insurance employees, as the same would cause ripple effects in the banking and other similar sector. "

Though these exposures by the Under Secretary, Ministry of Finance have no relevance to LIC pensioners case and HC Jaipur verdict, BUT the same do exhibit the arrogant and stubborn attitude of the Central Govt. particularly the FM towards just and legitimate demands of pensioners of LIC which have been accepted and held lawful by various High Courts of the country (and the same situation is for Bank pensioners also).

About an year back I had also sent a request letter to about 600 MPs including ministers, but none had responded as they know that pensioners are incapable of creating any nuisanse because of their patriotic nature and advanced age  and does not have much effect on their elections. Any way we have to continue our legal fight with high spirits till we get full justice.

AIIPA SAYS, LIC MANAGEMENT SHOULD FIND SOLUTION AS PER BOARD RESOLUTION OF NOV. 2001...


In the latest Circular issued by AIIPA on 30th May 2013, it is stated that the Association has been continuously pursuing the issues with the authorities for breakthrough.  "Our organisation has been constantly representing to the Management and the Government of India."




The circular continues..."the crux of our representation has been not to delay decision on increased ex-gratia for pre-1986 retirees in view of the ongoing litigation as this issue is not under the purview of legal proceedings.  Further, the merit of the demand for full neutralisation on Dearness Relief to pre-August 1997 retirees has not been called in question and hence the Management of LIC should find solution as enunciated in the LIC Board Resolution of November 2001 even before the culmination of the judicial process and in accordance with the stand taken now regarding the date of eligibility.

"Pensioners are aware that the SLP by LIC is before the Apex Court and the proceedings under the Contempt Petition continue to remain stayed till disposal of SLP.  As earlier pointed out, the SLP deals with only legal aspects and not the merits of the issue.

IT IS TIME TO PUT PRESSURE ON LIC MANAGEMENT.
  • "Taking into consideration the present scenario, the Organisation felt it was opportune time again to put pressure on the Management of LIC to come out with positive decisions and towards this end, have addressed a letter to LIC....
"AIIPA would like to assure that it will be its earnest endeavour to make the Management of LIC appreciate the need to revisit the issue as it stood in 2008 and initiate measures in whatever form required to bring to fruition the much desired and long awaited solution...."

Pensioners -
young and kicking!
Happy to note, your Editor is a '2004 model' pensioner!  I would sometimes think all the pensioner organisations should have their own 'Youth Wings'.  And it is my suggestion, persons who have retired from 2000 onwards should be considered eligible to be members of  their Youth Wings. Such pensioners should be entrusted with more responsible jobs. Having been afflicted with all sort of diseases, pensioners are these days fast becoming 'out-of-date-models' with no spares available to replace body parts that have ceased to function !

Happy, he has pension!
Pensioners are clamouring for justice with anger and anguish.  Your editor's words  that he is a happy guy, that he considers himself to be rather fortunate to enjoy benefits like pension which many did not enjoy at all in LIC, that he could continue in service upto 60 years, etc. makes interesting reading.  To look at the brighter aspects of life and to remain happy is  a positive and sure way to remain contented, quietly satisfied and happy in life.


Coming to court cases, the 'weak' among pensioners think for justifiable reasons, "time is precious".  So please don't procrastinate! Shri K. Sundararajan, Bangaluru has written in his article "stop endless emails and circulars".  It is like riding a horse inside an earthen pot, "many are departing and atleast awaken now!  

In fact signs of more pensioners becoming restless were found in the article "Wanted: Big initiatives!" where I found correspondence exchanged between Shri SC Kapur and Shri Ravindra Thakur.  They had a fascination towards arguments advanced by Shri M. Arunachalam. 

While Shri Asthana and Shri Jain think of taking forward the SLP to its logical end, it is time we also check with our friends close to the ruling party.  It is important that we know the thinking of the government in the matter.  The Govt. and LIC will immediately react that the matter is in the court. But then, are we not entitled to ask through influential persons that they enter into a dialogue with us. That will have the advantage of an early settlement (?) in this matter which involves the fate of thousands of pensioners, "many of whom are departing" as Shri Sundararajan has put it. This is only one option; the other option is already open...

SEEKING ADVICE FROM SR. ADVOCATE IN SLP CASE.



MY SELF, SHRI ASTHANA, SHRI S.K. SHUKLA AND OTHER OFFICE BEARERS ARE RECEIVING FREQUENT CALLS REGARDING OUR FURTHER STRATEGY IN OUR CASE AFTER THE JAIPUR COURT ORDER DATED 20/5/2013.  MANY SUGGESTIONS AND ADVICES ARE COMING AND CONFUSING THE MINDS.

  • SOME ARE PRESSING FOR GOING TO S.C. WITH AN APPLICATION FOR EARLY HEARING OF SLP.  
  • SOME ARE ADVISING FOR APPLYING IN JAIPUR COURT FOR IMPLEMENTATION OF BHANDARY'S JUDGEMENT. BOTH THE ADVICES HAVE THEIR PROS AND CONS.

AS SUCH WE HAVE DECIDED TO HAVE AN EXPERT OPINION FROM SR. ADVOCATE AND GOING TO DELHI ON 23RD JUNE. AFTER TAKING HIS ADVICE WE MAY BE ABLE TO TAKE ANY DECISION. 

MEANWHILE ALL ARE REQUESTED NOT TO DISTURB SHRI ASTHANA IN HIS WORK. HE IS BUSY PREPARING THE POINTS TO BE DISCUSSED WITH SR. ADVOCATE.

WANTED: BIG INITIATIVES...





I am a pensioner ( 2004 model ! ). Therefore my stakes are different.  
Normally I am a happy guy.  I look at things in a different way.  Every 
time I only think of those less fortunate persons who retired from LIC 
with PF and Gratuity. I consider myself as lucky that I retired atleast 
with a pension amount to be drawn every month to the rest of my life.
I  am again lucky because I could continue in service upto 60 years 
while others retired at the age of 58 years.  Also I am lucky compared 
to those who retired prior to 1997(pre-1997 retirees). 

Pre-1997 retirees have almost won their case without an iota of doubt.  
But they don't get the amounts due  for one reason or the other.  Of course 
pension updation question is also there.  Personally speaking I have
a feeling that the question of DR should engage our immediate attention.

Out-of-court initiatives from pensioners' orgns. soon...
Here is a correspondence being published.  While I am happy about the confidence expressed by them about LIC Pensioners Calicut, such initiatives will not at all solve the problems confronting LIC pensioners. You will soon find pensioners' organisations coming forward to do this job, it is hoped.  (With the approval and blessings of the then LIC Chairman Shri MG Diwan, Shri Sundaran, AIIEA Gen. Secretary, Shri Nachane Federation Gen. Secretary, I tried to conduct a meeting of LIC management and Employees Unions at Calicut, but it was successfully sabotaged by a management man at Calicut which story I have already published in my articles 'MY LIC DAYS - My life and struggles'.)

The need of the hour is that capable persons/organisations should 
come forward to do something.  When more and more individuals come 
forward with different ideas, there will emerge a definite solution acceptable 
to all and surely things will get going. 

If this discussion paves way for such initiatives, I would consider myself
to be a happier person...

  • "I can assure that I have no personal animosity or rancour against anyone though I have at times commented on the policies followed by others and such comments were based on my sincere assessment of the situation, which, as I believed, was necessary in the common interest of pensioners as a whole and the starving section of the pensioners, and it was my democratic duty also to express dissenting views but believe me that I had not made hurting remarks against anyone personally. On the contrary I was at the receiving end.

Let us all pray for success in all actions taken by anyone in the interest of pensioners. I am as eager as anyone else to move forward towards what are achievable."

WORKING TOGETHER IS SUCCESS.

This might better illustrate the principle:-

It was sunrise. A troop of Boy Scouts gathered for their annual hike in the woods. They began the 15-mile trek through some of the most scenic grounds in the country. About mid-morning, the Scouts came across an abandoned section of railroad track. Each, in turn, tried to walk the narrow rails, but after a few unsteady steps, each lost his balance and tumbled off.

Two of the Scouts, after watching one another fall off the iron rail, bet the rest of the troop that they could both walk the entire length of the track without falling off even once.

The other boys laughed and said, “No way!” 

                             Challenged to make good on their boast,
                                                                    the two boys jumped up on opposite rails,
                                                                               reached out and held hands to balance each other,
                                                                and steadily walked the entire section of track without falling!

SHRI GN SRIDHARAN WRITES -


I appreciate the humorous cartoon, in your blog, while posting the recent order of Jaipur H.C. After reading the order, I have an obligation to write as below in the interest of our pensioners.
I do not claim to be a legal luminary nor do I have any sycophant to hail me as such. I however state in all humility that I have been a fairly successful Lawyer with a standing of 23 years in Madras H.C. My experience, however little it might have been, made me always feel that ‘contempt’ proceedings have been unduly prolonged and multiplied to the detriment of our pensioners.  I have expressed this view, not once or twice but very often in writing as well as my deliberations in pensioners’ forums.  True, many were not comfortable with my opinion. Courts do not punish by imposing fine or  committing the  alleged contemnors to civil prison unless blatant violation of the court order or a complete disregard for the same is proved by the complainant.  It is time that our friends learn this truth. 
It has indeed been a sad scenario that a section of people who retired at higher levels after availing successive wage revisions of 1997, 2002 & 2007 are not kind to their own senior colleagues who are drawing one-half or one-third person.  Are they not hit badly on multiple counts? Is it not harsh when they are already octogenarians or near about to reach? Do the Pre-97 retirees not deserve a benevolent consideration? Only yesterday, I saw a letter from the combined forum of bank retirees clearly expressing that the DA disparity must be dealt with on top priority in their negotiations. Why then only our folks take a different stand? When our Federation collectively urged me to take up and tackle the DR disparity on priority basis, various steps taken by me were subjected to bitter criticism and uncharitable remarks made which I would not like to quote.
