LEGAL ASPECTS OF OUR CASE BEFORE THE SUPREME COURT







The various posts in LICPC by our experienced senior pensioner friends are enlightening. From an academic angle these provide full justification for our twin demands of DR relief and Updation.

Valid points of law are one aspect of the game. The courts function according to their own rules and practices. How best our counsels rebut the opponents' arguments spontaneously and well supported by case laws and constitutional points, is what matters. I donot think judges will be swayed by considerations of emotions or matters like the age and health conditions of our pensioners.

We can speak anything at a gathering of our general members but our advocates cannot do so before the bench.  You rightly said that beyond a certain point even our counsels do not allow us to brief them on all things we know (or which we feel we alone know better.) For that matter even our physicians and medical experts do not allow us to tell them on aspects over which
they alone are professionally competent to speak.

Let us pray and hope that our counsels make mince meat of the arguments of  opponents and win the case for us.
