I have gone through your 3 mails dated 14th June with copies sent to about 100 persons.
Besides one letter addressed to me, there is reference about me in the other two letters also and the civility demands that I write to clear my reputation.
It is necessary for me to inform my readers in the beginning how our relations soured (1) I deposited Rs. 56000/- in your personal account and asked for the receipt. You refused. I wrote to the GS/RBK suggesting (a) institutionalize working of the federation. (b) need for financial discipline. (2) I promised to send one lac to the federation in return of the federation taking up my case in the Supreme Court. I received a message from A.L Dhawan (Retired SDM Jaipur) that Rs.50000/- should be paid into your personal account I refused.
Now we can proceed.
- 1) I came to Delhi on 07.07.2013 to meet the senior advocate with you and you say that I indulged in some entertainment in Delhi Cantt and got late. The fact is I telephoned to inform you that I and Mr. TC Chopra are stranded at Dhaula Kouna for want of transport and we may get late by a few minutes. We were late reaching by exact 15 minutes. But is it of any importance or you just want to make it out that I am irresponsible.
- 2) As we set down to talk that afternoon my first question to you was why you have engaged a Senior Advocate for Chandigarh at this initial stage when only Notices are to be issued? You reply was ‘Jaipur case comes up in the S.C. a few days later. I want Jaipur case should come up for hearing before your case is called up. Only a senior advocate can convince the court for that.’ So Mr. Asthana you engaged P.S.N. for YOUR case Chandigarh did not need him at that stage.
- 3) The amount presumed to be paid to PSN keeps on changing. On the first day Mr. Jain said we engaged PSN for 2 lacs. A few days later he said we made him agree to charge one lac only because there was no hearing. On another occasion he said it was 1.5 lacs. At Udaipur, in presence of RBK you said 50,000/- In your letter of 14th June you write 2.5 lacs while in his letter to Mr. Mehta on 16.06.2014 Mr. Jain said 2 Lacs. Please make up your mind about it. In any case whatever it is, it was for the benefit of YOUR Jaipur Case.
- 4) Mr. TC Chopra spoke very politely but firmly, Mr. Asthana, you have collected lacs of rupees in your personal account but have not accounted for even a single rupees all these years. Such negligence can be fatal for a social worker. You reply, I ‘have complete account and will submit these after all the legal case are over’. How funny. Left to yourself you will file other half a dozen cases and let these linger on your lifetime.
- 5) During further discussion, you and Mr. Jain suggested that the Federation will look after Chandigarh case in the Supreme Court if the legal fund of Rs. 1 Lac in my possession is handed over to the federation. I agreed. On 19th July, the GS Ackd the receipt of one Lac and assured me in writing that the Chandigarh Case is now federation's responsibility. Mind you, it was after so called spending whatever money on PSN. Copies of this letter I have circulated among office bearers.
- 6) Sitting in the office of RK Singh next day you suggested that you will like to read the LIC appeal. It is not available officially but Mr. Singh can manage it with some consideration. How much I asked. RK Singh replied Rs. 10000/-. Sorry can’t afford it. Within a few weeks I got a copy free through another advocate – A case of organized loot.
- 7) You never told me anything about 13/2 which even RBK calls a debacle to haunt you for a long time.
- Mr. Murty may match his legal wits with you but I know of one thing which many do not know. Last year, you were making desperate efforts to intervene in our case at Chandigarh. Your friends at Chandigarh paid consultation fee to a service matter export who gave a written note that your line of action is wrong. Did you share this information with anybody?
- 8) You are allergic to Mr. Brijjit Singh because you are scared of working with a competent lawyer.
- 9) When we were together in Delhi on 4th April you persuaded me to file an appeal in the Supreme Court for their order to the LIC to implement the Chandigarh H.C Judgment. Mr. R.K. Singh was present. I told you frankly I do not know law but have a hunch that at this stage SC will not listen to such request. On your insistence I suggested you mail me the matter, I shall discuss it with my colleagues there and let you know. You said you don’t want Brijjit Singh to interfere in your case. I told you that I have great regard for Mr. Brijjit Singh but I can make you job easy. You better get in touch with Dr. Pritam. If he agrees, I shall send you an authority letter to file an application in the SC on our behalf.
- 10) Our President Mr. Sukhla was there staying with us. I told him you are bent upon filing an application in the SC and also informed him of my decision Mr. Sukhla said he was aware of everything and had told Asthana not to file any case without consulting him (Sukhla).
- 11) You got in touch Dr. Pritam whose advice was not to waste money and energy.
- 12) Inspite of advice to the contrary, you have filed an application for your impediment in our case with a silly suggestion that your impleadment will lead to early orders of the SC. Who will buy this arguments? You did not feel it necessary event to consult the President who had prohibited you from doing it.
- 13) We are going to oppose your entry in our case. Our advocate’s arguments will not be flattering to you. You will be responsible for bringing dishonor to the Federation.
- 14) If you file a case in the Supreme Court on our behalf, the Federation has enough money. But if we ask for financial help to oppose the LIC appeal, the GS says, it is your case, you find the money.
- 15) What is happening? It is all the way Asthana Asthana. His name. His reputation. His sacrifices His case, His money. If it goes like this Federation has no future, Nothing unreasonable lasts long.
- 16) I think I have entertained the readers long enough. More details next time.
- 17) Come on Mr. Asthana. Our days are numbered. I am 82. Let us sit together and settle our differences. After all, what I am asking for? Just financial help for my expenses in the Supreme Court to have a favourable order for the benefit of the entire pensioner community.
- 18) I don’t want to touch ‘your’ money. Let the President nominate a committee of eminent members to work with Mr. Murty and Dr. Pritam. Let them engage a senior advocate and pay him, his junior, and for other expenses related to the case in the Supreme Court. Is it asking for too much? Our action plan has been explained to you by Mr. Murthi.
- 19) Let us work together for a change. I am prepared to travel any distance to write a peace formula with you. I shall continue my efforts for united action. I like a couplet of famous Moulana Iqbal
