It becomes clear to any reader or recipient that by all standards, we get the fairly correct impression that we are nearing the FINAL SOLUTION with ifs such as - ALL 3 as pointed above — MUST SAY WITH UNANIMOUS VOICE that TWIN BENEFITS is articulated clearly in Hon SJ Bhandari’s judgement, adduced with reason & logic & cogently, succinctly analyzing various case laws, in unambiguous terms, to arrive at his decision thus projecting & promoting LIC Board Resolution as the kingpin, but with positive extensions & modifications, arriving at the inescapable conclusion of, as DB Judges rightly termed, as an UMBRELLA JUDGEMENT, of course, after hearing both the parties. With SC Bench earlier on 17 Oct 2012 spelling more clearly the earlier ambiguous 14 Nov 2011 judgement, specifying – Retiral benefits from the date of eligibility - meaning thereby Date of Retirement - which is an IMPORTANT CLARIFICATION. It is, therefore, imperative that all Pensioners Fedns, as AIIPA is not in the picture in Court cases, only AIRIEF & Fedn of Retd Class I Officers Assns must forget any other ideology other than as above & ensure strengthening of the fabric & mosaic of Unity & Synergy of the large body of aged Pensioners who will shower their blessings on the Fighting Force & Soldiers of the Triumvirate Jaipur, Chandigarh & Delhi emerging as Lords Brahma, Vishnu & Shiva, instead of upsetting the applecart of a probable, possible &even inescapable final solution, by unified, suave, cogent, purposeful arguments & submissions to Hon Learned SC Bench with masterly courtcraft, the summum bonum of clinching an unforgettable, everlasting, summit of Victory after fighting Kurukshetra legal battle with all its meandering course with such unbelievable patience, persistence & endurance, unparalled in the History of legal proceedings & jurisprudence & most certainly to be etched in letters of gold. This cannot be a daydream but really well within our reach.
Such trying moments call for unity, sacrifice on the part of everybody to submerge differences,forget & forgive, embrace each other, adopt common unanimous point of view, be happy on the eve of submissions in SC, glued to your seats in SC gallery, listen with rapt attention in pindrop silence, witness same like IPL Cricket Finals with, suspense, perspiration, delight, thrill, inspiration,prayers & atlast judgement by Hon SC Bench in favour of pensioners without an iota of doubt, what more, patience, presentation, perseverance & endurance & Hon Judges maintaining the highest dignity & majesty of the SC towards adversely affected elders & pensioners fighting for last 12 years & more restoring equity & justice in the most befitting manner to the utmost satisfaction of ALL groups of pensioners. Are we to fight to lose in & commit the Suicidal act of killing the Goose that lays golden eggs? Simply Startling, there cannot then be any worse case than these acts of Self-destruction. I appeal to Sanity, to Wisdom, to Maturity, to Justice, to Moderation, to Humility, to Calmness, remove air of superiority, superciliousness, criticism of one serving as tribute to another, it smacks of lack of gentleness, cool & calm temperament, igniting unnecessarily fire of anger, which we pensioners must never fall prey as real Winner is one who never craves to claim he won, but from behind he gets reverence & recognition, which is more important than denouncing others.We have to exist before we can co-exist, never ever forget this dictum. We Indians act in haste & repent at leisure. We are not Snake & Mongoose to go on fanning the flames, which precisely has to be put down at the earliest point. Please STOP this DIRTY politics once for all. No mudslinging, no stone throwing.
All pensioners must feverishly endeavour to ENSURE SIMILAR Presentations of TWIN Benefits, much before the end of this month. Procrastination should be avoided & Decisiveness must step in. Keeping pensioners in suspense is not fair. Already pensioners are a worried lot as after the spectacular 8/8/2013 SC verdict dismissing LIC SLP 29956 & 29957 & admitting Sri Asthana’s IA 12 & 13 & all attempts by LIC to get a Stay thwarted on yet another memorable day 30/9/2013 when SC Bench eminently refused to grant stay by their firm order – NO STAY in respect of CWP 6676/1998 & allied matters, yet another Victory post but then onwards virtual decline as 8 months have passed by May end & not one inch we could move forward.
