A BALASUBRAMANYA


Dear Sri Asthanaji,

I have perused your detailed note regarding the strategies 

adopted by you in order to get the benefits secured by the 
SB judgment dated 12-01-2010 to all the pensioners
by seeking a direction from the jurisdictional court to 

LIC to honour the judgment in its letter and spirit.

  It is important to build on the strengths we have so far 
  achieved and reach the cherished goal in the minimum 
  possible time at minimum expense.

  The following are the milestones of our achievement, 

  through AIRIEF and you in particular :-

1) The LIC Board Resolution dated 24-11-2001
2) Hon. Mr. Justice M.N. Bhandari's judgment dated 12-01-2010, allowing both
the Writs re: 100 per cent neutralisation of DA/DR for those who retired prior
to 01-08-1997 & upgradation of pension.
3) Dismissal of LIC's Appeal to set aside the above judgment by the Division Bench.
4) Dismissal of LIC's Review Petition by the same Division Bench. 
5) Dismissal of SLP's filed by LIC in the Hon. Supreme Court.
6) While condoning the delay in filing fresh SLP's by LIC and allowing them converting
them as Civil Appeals, the Hon. Supreme Court was categorical in all the three 
cases in saying, " There shall be no stay against the implementation of the Jaipur
HC Judgment dated 12-01-2010 and connected matter."

As our efforts to get LIC to honour the Jaipur HC
judgment through Contempt Proceedings faced
rough weather, fresh WP's are filed before the
Jaipur HC to issue a Mandamus to LIC to honour
its judgment in question, so as to benefit every pensioner.


Things are proceeding in the right direction and
now the call of the hour is to take it to its logical
end. There cannot be any looking back or change
of course at this final stage, unless we are sure
of a better alternative.


In the meantime, our efforts to prevail upon the
new Government to clear the Board Resolution
and help the hapless pensioners without any
further loss of time, should continue.
