IS PLANTING THE STORY HERE THAT IN VIEW OF THE 30/9 SUPREME COURT ORDERS, LIFE INSURANCE CORPORATION OF INDIA WILL BE OBLIGED TO RELEASE PENSION BENEFITS TO THE PETITIONERS SHRI KML ASTHANA & OTHERS (LIMITED TO THE PETITIONERS ONLY) IN ACCORDANCE WITH THE SINGLE JUDGE ORDER DATED 12-1-2010 SO AS TO ESCAPE CONTEMPT COURT PROCEEDINGS IN THE RAJASTHAN HIGH COURT.
THE SUPREME COURT ORDER STATES "THERE SHALL BE NO STAY OF THE DIRECTIONS GIVEN BY THE LEARNED SINGLE JUDGE VIDE ORDER DATED 12-1-2010 PASSED IN S.B.C.W.P.NO.6676 OF 1998 AND CONNECTED MATTER".
The concluding paragraph of the order dated 12-1-2010 of Rajasthan HC is follows:-
"In light of the discussion made above, both the writ petitions are allowed. The respondent Corporation is directed to take a decision for implementation of the resolution dated 24.11.2001 passed by the Board. The respondent Corporation cannot provide different criteria for grant of dearness allowance to the existing pensioners based on cut off date i.e. 31.7.1997. The benefit arising out of the directions above would, however, be considered by the respondent Corporation so that every retired employee may get the same benefit."

SINCE THERE IS NO STAY OF THE ORDER DATED 12-1-2010, LIC MAY, SO AS TO ESCAPE FROM THE 30/9 SUPREME COURT ORDER, CONSIDER IMPLEMENTING THE ORDER IN RESPECT OF PETITIONERS SHRI ASTHANA & ORS. AND RELEASE THE AMOUNTS ALREADY DEPOSITED IN THE COURT TO SUCH PETITIONERS AS DONE IN THE CASE OF RETIREMENT DATE OF '1ST OF THE MONTH' RETIREES (WHICH IS IMPLEMENTED ONLY IN RESPECT OF PETITIONERS, IT IS BELIEVED). THIS WILL BE IN CONSISTENT WITH THE STAND TAKEN BY THE SUPREME COURT WHICH HAS ASKED LIC OF INDIA TO DEPOSIT THE AMOUNT DUE TO THE PETITIONERS ONLY IN THE REGISTRY.
