This Assembly of Pensioners of LIC/ Public Sector General Insurance Companies held before the ___________ Office of LIC/ General Insurance Company, in the city of ___________, on December, 17, 2019, feels concerned that the Government/LIC/GIPSA have been displaying a negative attitude over the demands of Insurance Pensioners renewal for 2 yr
On the occasion of Pensioners’ Day, the day to commemorate the historic Judgement in D S NAKARA case, Insurance Pensioners pledge to fight for their rights as enshrined in the verdict , that have been denied to them by the authorities, on a specious plea that the judgement is not applicable in their case.
This Meeting would like to underscore that the Apex Court verdict has declared pension is a right not a gratis, is a deferred compensation for the services rendered, is not at the discretion of the Government.
As per the Judgement, a mini class cannot be created within the class of Pensioners covered by the same pension Rules, equal people cannot be treated differently without a reasonable basis that will be violative of Article 14 of the Constitution.
The Insurance Pensioners find the Government and the Managements of LIC/GIPSA have chosen to ignore these well laid principles in their attempt to deny the benefits of Full Neutralisation in Dearness Relief and Pension Updation.
Even before the judicial forum, their refrain has been non-applicability of the case law and non- availability of provisions for updation of Pension.
This Meeting feels that the Government has been procrastinating and had taken umbrage under judicial proceedings, wherein they have differentiated between a non -funded scheme as in Government and a funded scheme as in Insurance.
AllPA would like to pointedly focus to the decision of the Government, in regard to Pensioners of Reserve Bank of India.
Even though a case is pending, in the matter of Pension updation, in relation to grant of updated pension, to a section of RBI pensioners and though RBI Pension Regulations stipulate a funded scheme, the Government has notified Rules for increased pension for retirements up to November, 01, 2012 with proportionate increase for different periods of retirements.
This Meeting notes that the representation of AIIPA, inter-alia, on Uniform Rate of Family Pension and reckoning of last drawn salary for Pension are being favourably considered though decision is yet to come.
The Insurance Pensioners gathered here along with their brethren who could not come, but support the cause declare ,with all vehemence, that the Judgement in D S NAKARA Case, is eminently applicable to them also and the rationale thereunder makes them eligible for Pension updation and recent measures in RBI only fortifies their case.
The Members of AIIPA demand of the Government and Managements of LIC/GIPSA to shed the inhibitions, not to delay any further, but to immediately concede the demands of Full Neutralisation in dearness relief and Pension Updation and also to decide positively on other demands including Uniform Rate of Family Pension at 30% and criteria for determination of Basic Pension.
AIIPA, through this congregation, expresses its determination to continue its struggles and to take all necessary steps for realisation of its demands.
