NOIP LETTER TO ED (P) vis-a-vis MC JAIN CASE

In the NOIP letter to ED(P) on implementation of M C Jain case judgment, they have asked for inclusion of Class II retirees  also.

Even though I was originally of the view that Class II  retirees  are covered, I changed my view later after realising that there is no revision of wages for them on 1/8/1992. I think I wrote my revised opinion in Pensioners' Chronicle also quite sometime ago.

So the present position according to me is that only those Class I officers who retired between 1/8/1992 and 31/3/1993 are similarly placed as Mr M C  Jain.

They are entitled to get
  • Salary revised from 1/8/1992;
  • Pension revised from 1/11/1993;
  • Difference in commuted pension with interest ;
  • Difference in encashment of PL on retirement if any;
  • Arrears in respect of difference in salary and difference in pension.
