Dear Editor,

I normally lay stress & emphasis on quintessence of SC/HC orders & even there, in particular, the offshoots of such judgements.

I know for certain, as AIRIEF has a plethora of email contacts with many activists & with all circulation, clarification & dissertations periodically, many are not fully aware of the implications. Sometimes, we have to dispel simple doubts, ordinary calculations, convey again latest developments etc. More than the persons involved, which also may be important,but secondary, in my opinion, the openings we get arising out of such Verdicts are crucial, critical & vital.

I stand corrected as Sri Nidish Gupta figured, not on 30 September, 2013, but for earlier 2nd August, 2013 hearing & heard & decided successfully.Sri Abhisek Manu Singhvi was LIC Sr Counsel then too. I can never be sarcastic or caustic in my comments & I can never pour venom. Help Ever Pensioners & society & Hurt Never Anyone is my Motto. Pointing out accusing finger is a sad commentary & let us leave enough to politicians.

2) It is unfair to mention, ‘a Pensioners’Organisation’. Atleast we, AIRIEF have a distinct IDENTITY of our own,in existence for 18 years & more. Not only that we are unique as we have ALL CLASSES of pensioners,Class 1, Class II & Class III & IV. Of course, I have borne the brunt ,by now,for more than 15 years,& we know the full history, happenings, ups & downs, trials & tribulations, many bruises & injuries & yet doggedly we fought with LIC management & MOF/ UOI,& got so many achievements & accolades which has adorned several AIRIEF Souvenirs & also our website airiefvision.wordpress.com, which in so short a time from 21 January,2015 is touching 19,000 Hits. We were, we assert, with a sense of pride, creators of now famous LIC Board Resolution dt 24 th November,2001. Apart from so many other feathers in our cap, the most SIGNIFICANT is AIRIEF & especially Sri Asthana hit upon the great Right Brain idea of filing writs on DR 6676/1998 & pension upgradation CWP654/2007. These are now proving to be the KAMADHENU for ALL GROUPS of PENSIONERS & judged by many critical points & data I gave on 5 March 2015 ,which email I did send to Chronicle too, I & many pensioners are sure,the full-scale Summary will be a fine tool to Sri Asthana & Sr Counsel, Sri Nidish Gupta,who is a very Senior Counsel.

ii) I only know the pains I had taken, on the eve of 2nd August, to portray the panorama of pensioners journey, with a mission to achieve pension upgradation with inbuilt Full DR for all. I made it not only comprehensive but also categorical, shorn of emotional content, built step by step assiduously on reason, logic, events as they unfolded, especially stress on principles which all Courts do lay emphasis. PLUS please note we have such abundant RTI info, thanx to veteran specialists in AIRIEF, who, indefatigably apply, process, fup & all know the knotty, thorny path to get truth from such institutions & indeed we have succeeded. Some I quoted in my presentation, the SECRET letter of LIC to then Jt Sy,MOF dt 31/12/2001, 11/8/2003 etc., a potent source of info & a valuable document to be presented in SC, if required at the time of submission of arguments by our Sr Counsel.

* I quoted Justice Khandelwal Committee which rightly stressed on institutional settlements, not jumbo, so that ripple effect will not be seen, & full autonomy & powers to HRD, Personnel of organizations must be granted as a concomitant.

*When Article 226 of Constitution & Artcle 32 confers powers on High Courts & SC respectively to issue writs & mandamus against Govt, there is no need for any more appurtenances who will play only spoilsport. All those who cross the rubicon or Laxman Rekha will be booked by HC or SC. That is it.

*Ripple effect theory is an excuse, sidetracking the main issue, not resolving the problem, & to keep pensioners on tenterhooks. Don’t believe in that dictum. CGovt should have been the practitioners of the art, not mere preachers who announce from rooftops, but belittle in their own domain.

*With all such many-sided cardinal principles in pensioners favour, viewed from all angles, right, left & centre, normally nothing adverse can happen. God forbid, as torch of Faith is burning bright, it only means Court Emblem not honoured, in breach than in the observance. (It is IA 12 & 13 only.)
Beautiful & symbolic Balance signifying impartiality & neutrality, upholding of Equity & Justice, must not allow any worthwhile issues fought with candour & transparency to be buried under the carpet. SC cannot allow the death of Reason, it cannot & should not allow death of Truth or to trample Truth. If Truth dies, Humanity dies.

Historic judgment by SC.SLP of LIC dismissed by bench of justice Singhvi. Judgment will be applicable all over India. Lic wil have to pay more than 1000 crore to the pensioners.

1) After PENSION RULES 1995 CAME, GOT STABILISED, LIC CO SLOWLY & STEADILY CAME TO GRIPS WITH THE PROBLEM.-------- AS WE ARE AIMING TO HIT FULL PENSION REVISION WITH WAGE REVISION SUCCESSIVE & SO IF WE WIN THAT IS A GREAT FEAT & A LANDMARK FOR LIC PENSIONERS

2) LAST 15 DAYS WHEN AT INTERVALS, I WAS TALKING TO SRI ASTHANA, HE & ADVOCATES WERE DEVISING A STRATEGY TO GET SLP DISMISSED & ALSO TO GET FINAL ORDERS FOR SUCCESSIVE PENSION REVISIONS FROM 1/11/1993 OR DATE OF RETIREMENT AS PER SC ORDER 17 OCT 2012 & TO GET A DEADLINE OF 6 OR 8 WEEKS .THIS WAS BECAUSE IN GRATUITY CASE WHEN IT WAS TOSSED FROM JAIPUR TO SC & LATER FROM CHANDIGARH HC TO SC, SRI NIDISH GUPTA, LEARNED COUNSEL IN SC WAS ABLE TO DRIVE HOME THE IMPORT & IMPACT OF THE CASE & GOT SUCCESSFULLY SC ORDERS WITH 10 % INTEREST TOO  (This is what I had in mind about the qualities of head & heart of Sri Nidish Gupta) 

3) FURTHER, FORTUNATELY OR UNFORTUNATELY, SRI NARSIMHA IS NOT THERE TODAY AS HE HAS GONE TO HYDERABAD & WITH QUICK TALKS & MOBILISATION THAT SAME SR COUNSEL SRI NIDISH GUPTA AGREED AFTER SRI RKSINGH ALSO WAS CLOSETED WITH HIM EARLIER & YESTERDAY AIRIEF TEAM MET HIM WITH PRIOR PERMISSION AT HIS CHAMBER & DELINEATED ALL THESE POSSIBILITIES & TO WARD OFF, THEY ARE TRYING THEIR BEST TO SEE THE SC BENCH SIMULTANEOUSLY GIVES ORDERS TO IMPLEMENT TO LIC IN VIEW OF PLEA OF DELAY, DEATHS , ADJOURNMENTS, FREQUENT VISITS, COST & EXPENSES ETC

4) LET US PRAY FOR THE BEST THURSDAY SRI SHIRDI SAI DAY,SRI SATYA SAI DAY LET GOOD THINGS HAPPEN FOR THIS LONG LEGAL BATTLE AS FAIRNESS, EQUITY, JUSTICE & A PLETHORA OF VERDICTS ARE IN OUR FAVOUR & indeed RS 110 CR PA IS PEANUTS FOR LIC VIS-A-VIS RS 400CR FOR MIDDAY MEALS ,PLLI & WHAT NOT,A BARE 2.9 % OF TOTAL OPERATING EXPENSES IS WHAT ALL PENSIONERS GET, TOO MEASLY A FIGURE INDEED.

5) RE OTHER QUESTION, WHEN IN MAY 2013 & AGAIN IN LATE JUNE/JULY 2013 I CIRCULATED THAT FUNDAMENTAL FACTS & POSTULATES, IT WAS WITH A VIEW THAT FROM MANY MANY ANGLES OR FROM ANY ANGLE WE SEE PENSION UPGRADATION WITH EVERY WAGE REVN IS A MUST & SO I ADDUCED METHODICALLY POINT BY POINT REASONS FOR SAME & I EVEN ISSUED A POLITE REBUTTAL TO HUMOROUS NITHINS COMMENTS NO NEGATIVE REMARK HAS COME & ON THE OTHER EDITOR SRI PG GANGADHARAN SAYS VIEWERSHIP PAGES HAVE MULTIPLIED EVERSINCE AS MANY FEATURES & RAMIFICATIONS PENSIONERS HAVE COME TO KNOW NOW FURTHER, MY LONG DISSERTATION WAS TO DISPEL SRI GNS MEMBERS & SRI NATARAJANS MEMBERS ALSO TO KNOW REALITY OF SITUATION & NO ONE CAN GLOAT IF WE LOSE THE CASE,AS POINTS ARE UNASSAILABLE.NOW I CONFINED TO SOMEWHAT BRIEFER WRITE UP but TOOK CARE TO MENTION RELEVANT POINTS IN CASE LIC COUNSEL SHOOTS OFF SOME RELATED ISSUES SO THAT REPLY SHD NOT BE DIFFICULT & MOST PROBABLY IN YESTERDAY SITTINGS, ALL THESE MIGHT HAVE GENERALLY FIGURED.

v)Pensioners emails & feedback from 1 Aug 2013;Series No 59  (Extracts)

Dear Mr Kishore, As you have rightly stated,the clarificatory order that SC issued on 17th October 2012,read with the SB order of Jaipur HC makes it abundantly clear that the 
revised benefits as applicable from the date of retirement shall be payable to the 
past retirees.
Accordingly all the Class I & II Officers retired between 1/8/92 and 31/3/1993 
will have to have their pensions refixed as per the scales revised on 1/8/1992( 
confirming the judgment of Jaipur HCB in M C Jain's case).
Other pre Aug 1997 retirees will have to be paid the revised pensions as per the 
revised scales from 1/8/1997,1/8/2002, & 1/8/2007.The revision with arrear 
payments will also have to be made as and when the wage revision is notified 
effective from 1/8/2012.
This SLP dismissal also removes another anomaly automatically, viz that arising 
when any employee retired within 9 months of the effective wage revision date 
which may additionally benefit a small number of pensioners.
Let us hope LIC takes appropriate& proper steps that will prevent future 
anomalies and resultant litigations.
