This
refers to Shri Aggarwal's mail under the caption 'Jain case deplorable
compliance by LIC' substantiated by Shri Asthana in his mail.
According
to my remembrance the synopsis of the Jaipur HC judgement in MC Jain
case : The petitioner has now been declared entitled for revision of pay
scale as per notification dated 18-7-1996 with consequential benefit. (
Revision of pay scales retrospectively comes into effect from 1-8-1992
according to the court judgement).
As MC Jain retired on 31-3-1993 LIC should have paid the difference in
salary after refixation of salary from 1-8-1992 to 31-3-1993 as the
revised pay scale has come into effect from 1-8-1992 according to the
court order.
Pension has to be accordingly revised from 1-11-1993 and
paid till date. Interest at 10 % has to be paid for the arrears not paid
till the date of settlement.
I wonder how the figure Rs. 12500 was arrived
at. The figure should have been much more.

Jain court order, according to our own Chairman's contention, relates to
select group of pensioners who have retired between 1-8-1992 and
31-3-1993 and when he met our representatives confessed that there are
only a total of 41 cases and LIC will soon implement the court order in
these cases.
But nothing happened so far and not even a semblance of
action being initiated. In the meanwhile some beneficiaries known to me
left this world.
Where lies the solution ?
