The above case filed by the petitioners of CWP NO. 16346/10 came up for hearing on 7th July 2014. It was adjourned to 27th Jan. 2015 after the Court accepted the LIC offer to deposit in the Court within six weeks the amount due to the petitioners, and further, the Petitioners can withdraw this amount by applying to the Court for the same. Our advocate kept quiet by design and accepted the situation.

Lot of comments have followed expressing concern why 45 days to make 31 calculations and why wait for six months for next hearing, some with genuine concern and some just jeeringly.

As the case is of interest to the LIC retirees all over the country, I may be permitted to 
acquaint them of its background.

Our cause of action started last year when in AUGUST 2013 the Hon'ble SC disallowed stay
to LIC.
  • The Writ Petition prepared by Mr. Asthana to be filed in the HC for implementation of Nov.12 judgement was rejected by our Advocate being legally incorrect. Besides our own Advocate, I consulted a couple of other seniors including a Retd. Addl District Session judge. 
  • I was advised that in our circumstances the appeal under the COC ACT is the best solution. 
  • But I was warned to have great patience because Chandigarh HC traditionally takes such cases very lightly. And may take years before the final decision. Having been forewarned I take long adjournments with ease and would advise my friends not to feel disturbed.
Within one hour of coming out of the Court, and sitting in the court cafe over a cup of coffee,
I and Mr Brijjit Singh planned our future stratagem. We shall wait till 18th AUG. to confirm
the amount deposited by LIC and if needed, which appears certain, we shall file a suitable application in the Court.
