I have just seen Srinivasa Murthy's incisive in-depth analysis of the events leading to the Jaipur HC judgement. Until Asthana speaks about his future plans and strategy we have to wait patiently... May be he has something up his sleeves.
May be the SC comments of no further direction on IAs 7 & 8 of "no need for further directions" regarding deposit of further amount may have influenced the Judge's remarks on contempt which may have prompted Asthana withdrawing the contempt petition. But as he has rightly pointed out, the Judgement is very much actionable.
In my humble opinion Asthana and his co-petitioners must now insist that the judgment be implemented and the monies deposited be released, their basic salary be revised and they start getting the revised benefit every month hereafter; even if the calculation done by LIC is faulty. I don't grudge, I and other pensioners do not get it right now. But eventually all of us have to be paid. This should not, definitely, obscure or obstruct our efforts to get the pension upgradation and the accurate calculations of basic pay adding 11.25% of weightage and correctly calculating D A against the present faulty basis followed by LIC.
I hope someone takes up this suggestion seriously and persuade Asthana to plead for immediate implementation of the judgment and he need not fear of sounding selfish /protecting only the pre-1997 petitioners but must realise that this will pave way for extending the benefit to every petitioner, of course reserving his right to fight for upgradation & correct calculations.
