(I came across a news item which shows how callous LIC office may be in case of retired employees. It is unbelievable  that F No. D-16 was denied to the retd Dev Officer at Nasik Division. It was given only on court's intervention. Case details are as below. - MP AGNIHOTRI)

              
"LIC to pay ex-staffer for denying tax certificate

MUMBAI: Terming it harassment,The Bombay HC on Tuesday directed Life Insurance Corporation to pay Rs 10,000 as costs to a former employee who was not given Form M16-A for two financial years.

A division bench of Chief Justice Mohit Shah and Justice M S Sanklecha heard a petition by Nashik resident Vasant Kshirsagar (64) who joined LIC in 1972 and retired as a development officer on January 31, 2010. The judges said they were "saddened with LIC's conduct" and pointed out that Kshirsgar was its employee "for 38 years".

According to Kshirsagar's petition, upon retirement, he was not paid his monetary dues, except the provident fund, as LIC cited a pending litigation between him and LIC in a Nashik civil court. The dues were released only when Kshirsagar moved HC.
His petition said for 2009-10, Rs 12,000 was deducted towards income tax and for 2011-12, nearly Rs 40,000 was deducted. After his oral requests to LIC officers for form 16-A were not heeded to, Kshirsagar sent a legal notice to LIC in October 2012. The divisional manager (Nashik division) replied saying it is not mandatory to issue the certificate in Form 16-A to KshirsagarKshirsagar, who suffers from diabetes, blood pressure, spondylitis and was operated for prostrate this year, moved the HC saying LIC has given Form 16-A to all its employees, except him. His petition said he is entitled to nearly Rs 52,000 refund for two financial years, and he could not file his returns and claim refund due to non-submission of Form 16-A.

Kshirsagar's advocate Sachin Gite informed the high court that after filing of this petition, LIC furnished the certificate. The judges took exception to LIC's reply where it stated that it is not mandatory to issue Form 16-A. They questioned how LIC could deny it when it is the employer. The judges also observed that Kshirsagar had to move HC to get the form and added that this is "harassment" to the employee. They directed LIC to pay Rs 10,000/- as cost to Kshirsagar within a period of one month."
