Layman's comments ! |
We had published a layman-pensioner's opinion as follows:-
"3. "THERE SHALL BE NO STAY OF THE DIRECTIONS GIVEN BY THE SINGLE JUDGE" OF RAJASTHAN HC. THIS DIRECTION MEANS THAT THE PENSIONER-PETITIONERS CAN APPROACH HIGH COURTS WITH CONTEMPT PETITIONS. HIGH COURTS MAY PASS CONTEMPT ORDERS TOO. BUT LIC WILL APPROACH THE SC AGAINST ANY SUCH CONTEMPT ORDER AND IN ALL CERTAINTY THE NEW SUPREME COURT BENCH CONSIDERING LIC'S APPEAL AGAINST RAJASTHAN HC JUDGMENT WILL STAY OPERATIONS OF THE CONTEMPT ORDERS."
Came a sudden response from a reader as follows:-
Shri Basudeb Das, Kolkata has answered this point. He writes:
More readers may come forward to comment on this rather unusual order of the Supreme Court. There can be an argument that there is nothing "unusual" about the same at all. Maybe, the Court has issued such orders in the past also. If so, what was the implication of such orders in actual operation ?
"WHEN SC IS HEARING LIC’S APPEAL, IS IT POSSIBLE TO IMPLEMENT RAJASTHAN HC JUDGEMENT? REPLY MAY BE NEGATIVE TILL OUTCOME OF LIC’S APPEAL IN SC."

While laymen may express their fears (not necessarily legal discourses), experts may join the issue. Those close to our advocates conducting the case in the Supreme Court can obtain their views and pass on the same to the pensioners who appear to be confused on the subject.
