By inviting comments on the dismissal of SLP, you seem to have the knack of waking up the pensioners from their slumber to think and participate in some healthy discussion lest they may end up in dementia.
I am amazed over the legal knowledge the pensioner's fraternity possess as could be seen in Sampath Iyengar's analysis
and that of few others and I for one itching for some activity jump into the bandwagon to give a little more information on the dismissed SLP.
- Rule 7 of order 41 of the Civil procedure code says that no appeal shall lie against the order of the dismissed Review Petition.
- Further, SLP is not maintainable as the petitioner failed to show any error apparent on the face of the record.
- Law declared by SC is binding on all the courts and as held by SC in their judgment dated 4-9-2012 :1V CPC IA No 9 in TP(C) NO :56 of 2007 the order shall govern all similarly situated pensioners who have not approached the court and also those who have filed Writ petitions which are pending before various courts.
This sets at rest all possible doubts that one would entertain.
