Dear Sir,
Ref: Removal of Anomaly in respect of DR to Pensioners – Justice to
Pre-1997 retirees
We refer you to our several communications addressed to you in the
past on the above issue, and the various litigations relating to the same
pending or disposed off by High Court/Supreme Court.
It will be recalled that our Federation has filed a Writ Petition
(WP No.184 of 2006) in the High Court of Delhi on the specific issue of
discrimination on the basis of DR for pensioners by dividing them into two
groups based on an artificial cut off date, viz. 01.08.1997. The said W.P. was
allowed by the Honourable Delhi High Court by order dated 30.01.2013 read with
order dated 25.02.2013.
While so, out of the two Writ Petitions filed in the High Court of
Rajasthan (Jaipur Bench) against the decisions on which LIC had taken the
matter to the Supreme Court in SLP No.29956 and 29957 of 2011, one relates to
this issue of Discrimination on DR.
While disposing off the said SLPs, recently on 08.08.2013, the Supreme
Court has in its order recorded the fact that LIC has not challenged the
decision of Rajasthan HC. In this context, we demand that the Delhi High
Court’s order dated 30.01.2013 (read with order dated 25.02.2013) should be
honoured forthwith in the interest of the justice to the affected section of
pensioners.
We therefore once again call upon you to allow immediately 100%
neutralisation on DR with consequential upgradation of basic pension for
those who had retired prior to 01.08.1997. We are confident that the issue can
be sorted out without delay if the following factors are taken into account
dispassionately.
- The Board of LIC has already decided more than 12 years back that the discrimination of DR should be done away with, vide Resolution dated 14.11.2001.
- The Pre-01.08.1997 retirees are already receiving meagre/low basic pension, based on pay scales linked to 600 & 1148 points of CPI.
- The concerned retirees are in the advanced age 75 or so already, and they deserve relief before they depart from the world.
