Aboo’s anguish over the SC allowing LIC to file a fresh SLP
against Jaipur judgment although it is time barred is understandable. However
he need not fear that the whole case will be reopened for hearing.
The
constitution has not made Supreme court a regular court of appeal. The SC interferes only where
justice,
equity and good conscience requires such interference. Further
the point of reference for consideration should be one of constitution or an
important legal issue which needs the Apex court scrutiny.
In all earlier hearings no such issues came up for any arguments.
The time barred appeal which is allowed to be filed now and which has been
filed on 12th inst. does not merit reconsideration as it suffers from the lacuna
of pardonable delay and no constitutional or legal point which requires SC
interference could surface now all of a sudden.
Our patience has been tested too much and for too long but at this hour a little more endurance is
necessary.
