we have just received a brief note prepared by shri r.b. kishore on supreme court proceedings
on 15th april 2013.
LIC COUNSEL SH. MANU SINGHVI WAS NOT PRESENT IN FORENOON – THERE
WERE 3 JUDGES IN THE BENCH WHICH INCLUDED MR. JUSTICE KURIAN JOSEPH NEWLY
POSTED TO SC.
OUR COUNSEL MADE THE INITIAL PRESENTATION. HE SAID THAT AS PER PROCEEDINGS
OF 15-3-2013 WHEN SC BENCH ASKED LIC COUNSEL ORALLY WHAT AMOUNT LIC HAD
REMITTED FOR PENSION , THEY COULD NOT REPLY. EVEN NOW THEY MAINTAIN SILENCE ONLY ABOUT THIS
CRUCIAL MATTER.
LIC COUNSEL SAID THEY HAVE REMITTED FOR PENSION ALSO AND QUOTED
SOME AMOUNTS. OUR COUNSEL CATEGORICALLY SAID THAT MEAGRE AMOUNT REMITTED IS FOR
DR ONLY, THAT TOO FROM 1-8-1997 AND NOT FROM DATE OF RETIREMENT.
AT THIS STAGE, 2 JUDGES OTHER THAN HON JUDGE G.S. SINGHVI
INTERVENED TO KNOW ABOUT REVIEW PETITION IN JAIPUR HIGH COURT. OUR SR COUNSEL SAID THAT REVIEW PETITION WAS
DISMISSED AND PENSIONERS WERE WINNERS.

THE 2 JUDGES SAID AFTER REVIEW PETITION WHAT MORE REMAINS,
WHY THE SUPREME COURT IS AGAIN APPROACHED, OUR SR COUNSEL SHRI SHIV KUMAR
SHARMA SAID WE HAVE ALREADY MADE IT CLEAR IN OUR REPLY QUOTING JAIPUR HC HON JUDGE
SHRI SARMA’S VERDICT AND SO WE HAD TO APPROACH SC BENCH TO BREAK THE ICE.
WHEN HON SC JUDGE SINGHVI ASKED ABOUT SLP, OUR SR COUNSEL
SAID THAT WE HAVE NOT MOVED SLP, THAT SLP AS PER RULES IS NOT MAINTAINABALE
AFTER SO MANY POSITIVE VERDICTS.
THE 2 JUDGES OTHER THAN HON GS SINGHVI SAID THEY KNOW SLP IS
NOT TENABLE.
THEN AFTER A BRIEF INTERLUDE BETWEEM LIC COUNSEL SINGHVI AND
HON. JUDGE GS SINGHVI, COURT ROSE FOR THE DAY….
WE HAVE TO WAIT FOR SHRI ASTHANAS RETURN TO JAIPUR FOR MORE DETAILS. SH. ASTHANA HAD
DETAILED PLAN WORKED OUT IN TALKS AND CONSULTATION WITH OUR BOTH COUNSELS YESTERDAY TO HAVE A FITTING RESPONSE AND ALL SHALL BE APPRAISED IN DUE COURSE.
SRI ASTHANA WAS CLEAR THAT WE SHOULD NOT GIVE CREDENCE TO RUMOURS, WE MUST MAINTAIN OUR HIGH MORALE, SOME INEVITABLE DELAY HAPPENS, IN SUCH IMPORTANT MATTERS, WE CANNOT DICTATE TERMS OR DEADLINES TO HON COURTS AND MODESTLY WE ALWAYS EXERT PRESSURE TO NOTICE REALITY OF ELDERS & SR CITIZENS DESTINY AND SO DUE CONSIDERATION MUST BE GIVEN TO SUCH CRUCIAL FACTORS FOR EARLY SETTLEMENT.
