MC JAIN CASE IMPACT

Referring to the post of Mr A V Subbaraman,my comments are as under:

This will have no impact on our cases coming up in August 14.as this case relates to only a select group of Class I pensioners, retired from 1/8/1992 to 31/3/1993, although having wider implications for subsequent retiree-Class I Officers. But the real benefits when the judgment is implemented will be minimal unless 1) LIC resolves the DR anomaly before 1/8/1997 and 2) LIC pays interest for delayed payment. But I am not sure whether LIC will not try to link it in some manner to the Civil Appeals by filing a Review Petition in SC, which ,of course,will stand a 99% chance of dismissal. 
The Civil Appeals pending before SC concern all pensioners retired upto 1/8/2007 in the matter of removal of DR anomaly ( for pre-August 1997 retirees of all classes) and upgradation/revision of pension for all classes of retirees and the implications are more comprehensive and pervasive in my view .
