COMMENTS ON SC DEVELOPMENTS

After a prolonged wait the hearing of our case started In the S.C.  90 minutes of long hearing and then adjourned to 18th Nov. All pensioners eagerly waiting to know the proceedings should be thankful to YOU*PC & MSM for giving that full report and as many details.

Since nobody else sent any information so far to the pensioners; based on MSM's report I am writing this post. The summing up by him is that after such a long hearing 'none gained or lost except the presiding judge who understood our case fully'. This is one good thing that happened .


In the prelunch hearing as lIC counsel & S.J not present after a few minutes wait, the judge asked our counsel to commence. Thus without having the benefit of hearing the appellant we had to present our points. In that our counsel projected with thrust on Raj HC judgment and implemening Board Resolution etc ., We believed all the time this is our strong line to argue our case. How well this is received by the judge is given in MSM's report.

In the post lunch session the  LIC was asked  how they are going to defend their different rates of pension to pensioners depending on date retirement.


Also adding that they decide the Board Resolution & GOI Approval later. For sure this is favourable to us. Regarding payments of 20% in the reaction of the judge for LIC's submissions on that also is good for us.

We have 45 days time to restart our fight. Harping on &,pressing for implementing Board Resolution (Raj HC) has not gone well with the judge who without telling it conveyed that the BR of Lic is not STATUTORY as it requires GoI approval. However a bit of relief is these will be decided later.

May I request Airief Iegal committee under the guidance of our President who is endowed with legal expertise to evolve a new defense plan and approach for a strong presentation of our case in the next hearing.
