Punjab & Haryana HC order of 16-9-2015


Dear Editor,

We have read an order dated 16.09.2015 on your blog issued by Punjab &Haryana High Court Chandigarh upon an application moved by LIC seeking withdrawl of 20% amount deposited in this court by LIC so as to comply with latest supreme court order dated 07.09.2015.

As already known to all of us, similar application moved by LIC was dismissed as withdrawn on 20.07.2015 by the same  court .

Since I was personally present on both hearings dated 20.07.2015 and 16.09.2015 upon almost an identical or repeated issue /matter so I started thinking how same court can issue two orders which are almost poles apart on almost a similar application.. According to me as a lay man and not as a law man , following facts make this contrast happening.

1. On 20.07.2015, we were in very safe hands as case was argued by Sh. Murty himself .

2. Since hearing dated 16.09.2015 was conveyed to Sh. Murty only on 15.09.2015 late evening so it was simply not possible for Sh. Murty to be at chandigarh at such a short notice of say few hours only.

3. Due to demise of  father of our regular advocate Ms. Alka Chatrath just few days before, her junior Sh. Rakesh Sobti was assigned the task to argue for us.

4.No doubt, Sh. Murty burnt mid night oil to be in regular touch with Sh. Rakesh Sobti from 15.09.2015 evening to 16.09.2015 morning sending him all valuable in puts through mails,phone calls and smses so as to make him fully ready.

5. Since Sh. Atma Ram a very senior advocate was appearing for LIC and Sh. Rakesh being on our side being a very junior as compared to opposite side advocate so that made the whole difference during hearing dated 16.09.2015 .

So these are few things as a result of which this highly disturbing order is before all of us.

But our case manager Sh. Murty is not disturbed at all since he is always ready to face any tough situation and he is already in action for either recall or rectification of this order and hopes to achieve his new mission before supreme court hearing dated 23.09.2015. Let us all pray to God for success under fresh challenge in hands of Sh. Murty right now.
