I have seen the reply of Shri M Srinivasa Murthy. I find that there is an emotional surcharge of words.

In an organisation there will be large number of people. All the minds of the pensioners may not co-inside or may not be similar with that of the other.
  • We are confident in Shri K M L Asthana will receive all the advises of the member in a cordial manner;
  • We are confident in Shri K M L Asthana because he is trustworthy;
  • We are confident that Shri K M L do work whole-heartedly and sincerely for the cause of pensioners;
  • We are confident that Shri K M L Asthana is the father of pensioners cause;
  • We are confident that Shri K M L Asthana is straining every nerve for the cause and prosperity of the Pensioners;
  • We are confident that Shri K M L Asthana brought many victories which help the pensioner’s genuine demands, the L I C is simply defying the court orders for which he is not responsible;
  • Our faith and trust in Shri K M L Asthana could not be shattered with any body’s comments; 
  • We may accuse SUN and Moon but they do their duty most diligently do not care once comments;
  • Our faith in Asthana cannot be shatters by anyone it is nothing but trying to hit the Himalayan Mountain;
  • We are confident, we are having in Shri Asthana and we accept him as our leader any attempt by anyone to split AIRIEF is an attempt could not break the Himalayan Mountain but nothing else.
Please understand, do understand that we are not sycophants. We can decipher good and bad.

Friends, 
Enough bad blood got generated already. As long as Mr Gangadharan’s colourful platform is available, we can merrily continue the tirade against each other.  But it is not desirable to do so, as we have serious business to take care of with high stakes to LIC pensioners.

Many reckless and baseless allegations are made against me like I am ducking questions, that I am an agent planted by another Federation to malign this Federation, of creating fissure between Jaipur and Chandigarh etc. All these allegations are just cheap gibberish and do not deserve any response from me by way of a formal denial. Although I suspect that at least some of these champions are perhaps tutored to say so, I still ignore them.  
  • I am being asked to make concrete suggestions instead of questioning anybody.  Don’t you see that that is exactly what I have been doing all these months? Please re-read my posts to the Chronicle. The concrete suggestion is that the Petitioners in each of the three HCs should pray before the Supreme Court for directions to LIC to implement their respective HC Order. They should also refrain from interfering in or interpreting of the ‘other’s Judgement. Is this a diktat or a suggestion? I also mentioned that if this suggestion is not a good one, please share your plan if you think you have a better one. 
  • In the above context, please enlighten yourself and others on what is actually happening on the ground. In my Note titled Inconvenient Questions, I asked what outcome you expect from the two new WPs. 

I look forward to an honest answer from any of the champions.

Someone says he will be happy to sink or sail with his Captain. Please do so by all means. But please check if the pensioner community in general is expecting to sail or sink.  
I am ready to answer any and every question to prove my bonafides. But I wish to write or talk (on a one to one basis – only if they are interested) to the few who are not comfortable with me and my role. It is because putting certain facts in black and white would mean washing the dirty linen in public. It doesn’t help our cause.

RAISED ONLY PERTINENT QUESTIONS, SAYS KS RAMAN

Dear Sir, 

I wish to introduce myself as an office-bearer of RIEA, Madurai Unit & the Unit was formed just 4 years back and got affiliated to AIRIEF in the presence of Sri. R.B.Kishore, Vice-President of AIRIEF and Sri. G.V.S.Mani of RIEA, Chennai Unit. When the audience heard the achievements of AIRIEF through the powerful speech of Sri.RBK, there was a big ovation and appreciating the hard efforts put in by Sri.K.M.L.Asthana in winning the twin demands in Jaipur Bench of Rajasthan HC, Madurai Unit had swelled with members' strength. Every member is fully satisfied with the way the court cases are handled by Sri. Asthana in consultation with the stalwarts like M/s RBK, C.H.Mahadevan, T.R.Madhava Rao, R.K.Viswanathan and a few more legal luminaries. 

FACT remains that Sri.Asthana has never faced any defeat in the court matters in any stage, be it in SB DB of Jaipur Branch of Rajasthan HC or Supreme Court, in spite of hurdles from our own sister units. Their only motive is to demoralize our champion and sabotage his honest efforts towards all round benefits of the entire pensioners' community. Alas !  We only pity them when we see that they are fighting against the interest of themselves / their own families.

Having failed to tilt the situation to their favour, they have started hiring some other agents to intrude into our camp and create confusion. One such agent started putting forth his counsels to Sri.Asthana to take our cases forward. We foolishly believed that this gentleman has emerged afresh to lend his legal experience for winning our case shortly. But within some six months Sri. KML ASTHANA & Sri. RBK have understood the true colour of this agent and started distancing him from our activities. Naturally he must have got frustrated. Hence he has started blabbering that Sri.Asthana's legal efforts will not yield the desired fruits and that he is unnecessarily wasting funds, etc, etc. Knowing well that there are no takers for his so called Action Plans & Unity Moves, he has come out with his original plans of  thwarting the moves of AIRIEF.

We know how to conduct our business. We need no expert advice from TOM, DICK or HARRY. Wisdom is in plenty amongst our camp. We have got hundred percent confidence in the leadership of our Organisation and the path chosen by Sri. Asthana in legal matters. Let him understand the following motto of our Organisation.

' WE ARE PREPARED TO SAIL OR SINK WITH OUR CAPTAIN.'

MOST OF US ARE NOT AWARE OF THE CASE FILED IN JAIPUR HIGH COURT BY SHRI ASTHANA,UP TO THE THE YEAR 1998. ALL THE PENSIONERS KNOW THE DETAILS OF THE CASE AND JUDGEMENT FROM 12 10 2010. ALL OF US ARE AWARE THAT K M L ASTHANA FILED A CASE 6678/1998 IN 1998; 2) 654/2007 IN 2007. FINALLY ON 12 10 2010 THE JUDGEMENT IS DELIVERED BY SJ M N BHANDARI ADMITTED THE TWO WRITS AND ADVISED LIC TO IMPLEMENT THE BOARD RESOLUTION DATED 24 11 2001. BUT THE L I C DID NOT IMPLEMENT ITS OWN RESOLUTION DT 24 11 2001.

THE L I C HAS GONE TO THE DIVISION BENCH OF JAIPUR AND THEIR APPEAL IS DISMISSED. MORE OVER ADVISED L I C TO IMPLEMENT THE BOARD RESOLUTION UNDER THE UMBRELLA OF THEIR JUDGEMENT --- L I C DID NOT OBLIGE.

L I C FILED A REVIEW PETITION IN JAIPUR H C AND FILED AN SLP IN THE SUPREME COURT. REVIEW PETITION FILED IN JAIPUR HIGH COURT IS DISMISSED. THE SLP FILED IN THE SUPREME COURT IS ALSO DISMISSED. - LIC DID NOT IMPLEMENT THE COURT ORDER.

L I C AGAIN FILED SLP IN THE SUPREME COURT WHICH WAS ALSO DISMISSED AND PERMITTED LIC TO FILE AFRESH SLP AND IT WILL BE CONSIDERED ON ITS OWN MERITS. THE SUPREME COURT CONVERTED THE SLP IN TO CIVIL APPEAL AND MENTIONED THAT THERE IS NO STAY ON THE JAIPUR HIGH COURT JUDGEMENT. – BUT LIC DID NOT HONOUR THE SUPREME COURT ORDER.

THE JUDGEMENT OF ANY HIGH COURT IS BINDING ON ANY INSTITUTION INCLUDING THE UOI. “L I C IS A STATE, THE JUDGEMENT OF ANY HIGH COURT SHOULD BE IMPLEMENTED IN TOTO. (MADRAS HIGH COURT)” - BUT L I C IS AVOIDING THE IMPLEMENTATION OF THE COURT ORDERS.

THE JUDGEMENT OF CHANDIGARH AND ALSO OF DELHI ARE BASED ON M N BHANDARI JUDGEMENT ONLY. 
RECENTLY, SOME UNWANTED CRITICISM KNOWINGLY ARE UNKNOWINGLY STARTED CRITICISING SHRI K M L ASTHANA, MAY BE FROM A MEMBER OR FROM A NON MEMBER COMMENTING ON EVERY ACTIVITY ON EVERY POINT ALMOST SERIOUS CRITICISM LEVELLED AGAINST, WHICH IS NOT GOOD IN THE INTEREST OF THE ORGANISATION. THE VERY SAME PERSON IS NOT ABLE TO SPELL HOW FAR THE UNITY TALKS HAVE REACHED WITH SHRI GNS? HE IS NOT TRANSPARENT IN HIS REPORTING!

ONE CAN ADVISE AS A MEMBER THROUGH PERSONAL APPROACH THROUGH ORGANISATIONAL NORMS AND FORMS BUT IT CROSSED CERTAIN LEVEL. THIS IS STARTED FROM THE PAST 6 MONTHS WHICH IS NOT HEALTHY IN THE ORGANISATIONAL INTEREST. I HOPE THE WISDOM DO PREVAIL ON HIM TO MAINTAIN DECORUM IN HIS EXPRESSION AND ALSO IN HIS THOUGHTS. 
I AGREE THAT THERE IS DELAY IN THE JUDICIAL PROCESS FOR THAT SHRI ASTHANA IS NOT RESPONSIBLE. JUDICIAL SYSTEM IS LIKE THAT. WE ARE NOT LIVING IN UTOPIAN COUNTRY. ONE THING WE SHOULD REMEMBER THE DELAY IS NOT TOO MUCH. EVEN FOR THAT SHRI K M L ASHTANA IS NOT RESPONSIBLE?
SOMEONE HAS MENTIONED ‘EGO CLASH’. WE KNOW WHAT SHRI ASTHANA IS, HIS VIRTUE, GOODNESS TO ACCEPT EVERYBODY’S OPINION HAS BROUGHT TO A STAGE FOR FINAL CULMINATION OF STRUGGLE ON AT JAIPUR ON 21 07 2014, FINALLY ON 12 08 2014 IN THE SUPREME COURT.

WE NEED TO APPRECIATE THE TRANSPARENCY WHATEVER IS HAPPENED AT 11 O’ CLOCK AT JAIPUR HIGH COURT OR AT THE SUPREME COURT, THE PENSIONER AT MADRAS, A PENSIONER AT MACHILIPATNAM AND IN A SMALL PLACE LIKE NUZVID. IT IS THE SINCERITY OF THE LEADERSHIP. FOR THAT WE AS PENSIONERS NEED APPRECIATE.

THE AGE BRINGS MATURITY OF ONE'S THOUGHTS.  MY AGE HAS NOT BROUGHT ME THAT MUCH MATURITY AS THE CRITICS DO NATURALLY HAVE! SO, MY APPEAL MAY BE CONSIDERED AS A SUGGESTION FROM YOUR YOUNGER BROTHER. LET US NOT MUDSLING ON OTHERS, LET US HOPE FOR THE BEST FOR PENSIONERS FRATERNITY. LET US STRENGTHEN THE HANDS OF AIRIEF THEREBY WE ARE STRENGTHENING OURSELVES.

I don't know how to describe the latest outbursts (personally against me) of Mr SP Sood and Mr K S Raman (carried in the Chronicle). I think these two gentlemen are either genuinely unaware of the full facts and the background in which I have been airing my views (AND also perhaps NAIVE) OR are deliberately following the cheap strategy of 'offence is the best form of defense'. In either case, I would appeal to them to patiently go through my two detailed posts in the Chronicle on 22nd and 24th May.

Let us stop acting like professional politicians - if you have no case to defend, attack the other side. That is what is happening now.

I have expressed my views, explained my concerns, made my suggestions and raised some simple but significant questions. Instead of meeting the points and examining the suggestions to decide if they are worth being followed, as many more pensioners are also asking, these two three people started attacking me. I can and I will endure for now. I would still ask them to go through my two postings on 22nd and 24th May. Even if they avoid, I don't mind. But one more un-parliamentary epithet or abuse hurled personally against me, I think they will regret for doing so.

If the AIRIEF wants to dismiss my views and defend totally what one man is doing, let it do so, openly. I have no control. But AIRIEF should then be willing to accept the responsibility of the consequences. If it helps the Pensioners - full credit to it. I eat my words back and publicly apologize for intervening (in what some people seem to be treating as their private litigation). If it ends up in irreparable damage to the trusting pensioner community, which includes avoidable and killing delay in getting the relief, AIRIEF leadership will go down in history, either as helpless spectators or willing accomplices to wrong strategies.

At the cost of repetition, I have only been canvassing that each of the Petitioner group (Jaipur, Delhi and Chandigarh) press for Directions from SC to LIC in the 2nd Week of Aug, to "IMPLEMENT" their respective Judgments. Anything more they say, will boomerang and LIC will take advantage. My two Posts in the Chronicle are worth reading once again by Mr Sood and Mr Raman. If they still want to hate me, I can only sympathize with them.

      1. DA/DR - ANOMOLY FOR PRE-97 retirees

      2. Updation

      ITEM no 1 should be implemented at once without linking with updation. This will remove disparity among the pensioners giving relief to pre-97 pensioners, who are touching above 80 yrs of age.

      The updation should be taken-up as per the jpr-verdict of the high-court. THE associations should give-thought to our suggestion at the earliest possible TIME.

      We, the pre 8/1997 pensioners were hoping that Sri. P. Chidambaram, the erstwhile UPA Govt. Finance Minister will give us a parting gift by amending LIC Employees' Rules, 1995 and approving LIC Board Resolution of 24-11-2001 about removal of DA anomaly and about refixation of pension on wage revision. But this did not happen and he left, leaving all of us in the lurch. 



      Now that the new Government has been formed in the Centre with a brand new Finance Minister (with, shall we hope, a liberal mindset) our hopes are re-kindled.  In this connection, we all wish that ALL the LIC pensioners' Associations join together and collectively meet the new Finance Minister, Sri. Arun Jaitley, explain the background of our anomalies and request him to unearth the LIC Board Resolution of 24-11-2001 hidden somewhere in the Finance Ministry, and give life to it by approving it. 

      Sri. Jitendra Singh is the new Minister Of State for Personnel, Public Grievances & Pensions and he may also help solve our problems, if approached. 

      The above suggestions are made as a step of Out-of-Court settlement and to hasten the implementation of the Board Resolution of 24-11-2001. 

      If, even this Finance Minister cannot give any hope and say that the matter is Sub-Judice, then we have to sit with our fingers crossed, expecting for Supreme Court judgement, which may or may not be in our favour.

      CRY HALT Mudslinging... Let all the musings, murmurs, stray or random thoughts or well intended lash outs be embraced/taken very sportively by all pensioners - irrespective of one's position, may he be the leader or the led. 

      • The LICPC in short is doing yeoman's service in as much as it shares authentic updated information for benefit of not only the LIC pensioners but also of Banks, RBI and GOI pensioners and other readers including the working employees.
      • The LICPC has become a knowledge bank - the latest revelations by Shri Ashtanaji that the pensioners of the courts too had to fight in courts including in the Supreme Court for twelve long years - is an example which many did not know or could imagine!

      All individual leaders, some single handed, and all leaders of different Associations, Unions have been fighting for the cause of the pensioners, for two main burning issues, viz. updating of pension along with every revision of pay scales of serving employees once in five years and 100% neutralisation in Dearness Relief to pre August 1997 retirees ( None have petitioned updation more than the stage to stage fitment/OROP or 100% DR to Post August 1997 retirees for obvious in any Writs.) The leaders contribution to the pensioners lot would not/never go unrecognised. The pensioners' community by and large have bestowed full faith in their leaders. They also understand the functioning/short comings (delays, frequent adjournments) of the legal system in our country. They also appreciate the ' limitation - the periphery- physical, financial - within which the leaders have to play their roles. They, however, by virtue of affiliation, would like/love to ( give ) credit a particular leader or Association. This is quite natural human behaviour, trait. This is also quite natural for many losing their patience, their temper because of long wait of fifteen years - unsure of seeing twin issues - resolved - at least few years before they bid good bye.

      ' It is an opportune time ' as some one has said. It is time that our leaders and we, the pensioners forget our differences, if any. No time at our disposal to play politic of any kind. May the wiser counsel prevail. May all the roads reach Rome. May all of us and all our leaders unitedly put in best of efforts to achieve our solemn goal of pension updation and 100% DA/DR.

      ASTHANAJI FOUGHT THE CASE HIMSELF AND WON IN COURTS

      Well written.   
      From 1998  onwards  Sri Asthanaji has fought the case  himself and won the
      the case in may Courts, all of us knew pretty well about this case, none of  us came forward to help him  in the process, now  on the verge of the implementation of the case  every body came and  gave not very useful ideas to  him, we believe in Sri Asthanaji's  strength, he has not sought any body's help and unwanted  ideas.

      The credit for a series of successes at the SB & DB of the HC of Rajasthan at Jaipur and the dismissal of SLP's filed by LIC in SC and its emphatic ' NO ' for a STAY for the SB Judgment of 12-01-2010 sought by LIC, should obviously go to Sri KML Asthana and the entire pensioner community is beholden to him for spearheading strategies to achieve the present stage, despite paucity of funds and indifferent health. This has, incidentally, been responsible for making the pensioners aware of the issues.


      With the sincere intention of persuading LIC, contempt proceedings were initiated at various rungs of the judiciary and unfortunately this strategy did not yield the desired results. This exercise involved delay and loss of precious money contributed by the pensioners and others, irrespective of their affiliations. Let me confess that I was one of those who felt so in hindsight and appealed to Sri KML Asthana to take steps to get a direction to LIC from the appropriate Court for LIC to honour the 12-01-2010  Judgment, by implementing its own Board Resolution of 24-11-2001 in its letter and spirit. The two Writs are now filed before the Jaipur HC for this purpose.

      The latest development is that the SC is taking up the three CIVIL APPEALS filed by LIC

      in the second week of August. It is, therfore, time for all the aggrieved parties to face the mighty LIC in a single and unanimous voice, to avoid avoidable delays and huge expenses involved, burying whatever small differences in approach they may be having. Let us absorb noble ideas and thoughts wherever they may come from, in the larger interests of a fast diminishing tribe, which will be grateful for the emerging benefit in the evening of their lives!
      • In this connection, it is worthy of note that Sri M.S.Murty has taken enormous efforts not only to interact with Sriyuths Asthana, Sridharan, C H Mahadevan, R.B.Kishore and other active leaders in the process of the present litigation but groups of pensioners in Chennai, Delhi, Bangalore, etc., in a bid to hammer out a strategy for concerted action. If this is acted upon - I do feel that the proposed strategy does not in any way infringe upon the on-going process adversely - there Is a bright chance of tackling the Civil Appeals of LIC coming up before the SC during August next. I do appeal to our respected Leaders, Sri Asthana, Sri Sridharan & others to assess the merits of the proposal mooted by Sri M.S.Murty objectively and adjust their stances suitably with a view to put an end to the long-drawn litigation and earn the blessings of the beleaguered pensioners. Pensioners, in general, are very well aware of the contributions made by our leaders and will also appreciate the sacrifices made by them personally and financially in their interests.
      • Needless to add, TIME IS OF THE ESSENCE ;  ACTION NEEDS TO BE FAST-FORWARDED
      It is hoped that all concerned will rise to meet this final opportunity before them or it will be:  " AB NAHIN THO, KABHI NAHIN " !

      MUDSLINGING?

      You are correct, 

      In the name of unity the initiator of such unity moves has started hurling mud and bricks... So I decided to express my views through the Chronicle.

      Shri Srininvasa Murthy started his campaign for unity (for what?) well, but seems to have strayed away from the right path and has started to attack and question Shri Asthana's motives, intentions, deeds etc. etc. Actually in the name of unity he has created a fissure between chandigarh and jaipur.

      At the start of his campaign he says he had talks with all those who matter, but has not revealed anything and probably left to the imagination of readers of the Chronicle. I learn that he is an important member of GNS Assn. Nowhere he has mentioned whether GNS has agreed to 'add' and concede that the board resolution does include upgradation of pension.  Now atleast will Shri Murthy clarify?

      About the funds Shri Murthy need not have any worry. The AIRIEF is fully capable of handling the matter and is in full control, of course with the cooperation of Shri Asthana. From Nagpur itself a sizeable number of non-members of the AIRIEF has contributed to the legal fund, directly to Shri Asthana's account and have no complaint. Each and every one them has expressed solidarity with KMLA and they have trust in his capabilities and dedication.

      It is matter of utmost regret that when at the fag end, things are well on way to the logical conclusion, someone wants to hijack the proceedings in the name of unity.

      Lastly, I would like to remind Shri Srinivasa Murty that even the Delhi court which heard GNS petitions has given the verdict based on Justice Bhandari's, which obviously was the outcome of the valiant fight put up by KMLA.

      With due respects to Shri. Murthy, may I point out that Shri Murty should make concrete suggestions to KMLA, but not thrust his decisions upon KMLA.

      Dear Shri Gangadharan, 

      I am happy to see your clarion call to "STOP MUDSLINGING'' and to move forward. It is timely and pragmatic. Mudslinging is bad, whether it is done by 'A' or by 'B'. So it should stop. Let's hope it does.


      You have always maintained the neutrality of the Chronicle. In that spirit, I fully agree with your view (I NEVER held a different one - my numerous mails on the subject prove it) that the entire credit for securing a first favorable court verdict belongs to Mr Asthana. There is no dispute as far as I am concerned.
      • My discomfort lies elsewhere. I should not be seen as opposing KML for the heck of it. I have been raising specific questions which deserve simple and straight answers. It is not an academic exercise. I am not interested in scoring points. My efforts are intended to ensure that the course of litigation does not go astray. Today it has already gone astray. I am in fact concerned about it. 
      Your clarion call (to do things) is loud and clear. If it happens as you have exhorted, the full credit of putting the litigation back on track, goes to you/PC - deservedly.
