SUPREME COURT CLARIFIES 'AMOUNT DUE TO EMPLOYEES'



 

The Supreme Court of India in its order of 17th October 2012 has issued clarifications as follows:-

"In the meanwhile, the proceedings pending before the High Court under the Contempt of Courts Act, 1971 shall remain stayed subject to the condition that within eight weeks from today, the petitioner shall deposit in the Registry of the High Court the amount due to the pensioners i.e. the writ petitioners with effect from the date of their eligibiity to get retiral benefits."

To the pensioners, it should be admitted, this is bad news.  We were under the impression that  LIC would make detailed calculations and deposit an amount running to several crores of Rupees in respect of all the retired employees. But the Court has clarified that only the amount due to the writ petitioners need be deposited.  The order of the Court is reproduced below:-

We have heard Shri Amarendra Sharan, learned senior counsel for the applicant and Dr.A.M.Singhvi, learned senior counsel for the SLP-petitioner and are satisfied that order dated 14.11.2011 needs to be clarified so that neither party may remain under a mistaken impression about the purport of this Court's order.
In view of the above, paragraph 3 of order dated 14.11.2011 is substituted with the following:

SUPREME COURT DEVELOPMENTS.


We have reported that there was no sitting of the Bench of Justice Mukhopadhyay and Justice Singhvi on 5th October 2012.  LIC’s SLP was therefore postponed to 26th November 2012.


However an application has been filed in the Supreme Court for early hearing of the Special Leave Petition.  Request is to consider the SLP  earlier than 26th of November 2012.  The Bench considering the SLP may look into  this request on 9th or 10th of October.


It is hoped that the Court may also clarify its own order regarding depositing  “amount due to employees”  which was the subject matter of  Contempt Petition in the Supreme Court. The contempt petition on this subject  was later withdrawn owing to what was described as “technical reasons”.

LIC's SPECIAL LEAVE PETITION IN SUPREME COURT.

You know it. Court proceedings are many-a-time a time consuming affair.

LIC's Special Leave Petition against the order of the Rajasthan High Court  was last listed in the cause list of the Supreme Court for 7th February this year. It was again listed for 5th October.

Now we have the news that the Special Leave Petition is postponed to 26th November 2012.

The result: Pretty well an year will be over with a couple of postponements.... and who knows, when our woes will be over once for ever.

Surely, not a pleasant situation for the Pensioners!
